Hello VJs..

My AOS package is ready...this is the list of ething that i am sending..

Please let me know if i am missing s'thing cuz m really tensed up and getting the feeling that i might miss out on s'thing..

Hubby is also bad at organising paperwork and stuff..

One issue that i have is my medical in home country was around the same time last year ..so if not exactly 12 mnths, its been 11 mnths 2-3 weeks over already..

But i am for the time being submitting my I 693 A supplement only...taking a chance on this..

Did anybody have an a similar situation and a lucky experience of not getting an RFE fr taking the whole medical again??

For I-485:

I've never heard of anyone submitting a letter to explain why they're "late" in submitting their AOS package. :huh: I really don't think it's necessary as I waited longer than you did after Bruce and I got married before submitting my AOS (6 months) and there haven't been any problems yet. I mean, you can submit it if you want, but I don't think there's any reason to.

You don't need to send in such a letter. It won't make any difference. Just keep it simple and remember, to double/triple check. All the best to us. :)

I don't think it would hurt at all if you sent such a letter. We just mailed our AoS package today and did not include such a letter, but that's because I was too lazy to include such a letter. If you've already written one, I'd say include it. It couldn't hurt and could only help, IMO. :thumbs:

It won't help at all because no explanation for filing AOS "late" is needed, AOS can't hold the fact you filed late, or were out of status, against you. Putting extra items that are not required into the packet can only cause issues IMHO. Best to keep to exactly what they ask for.

I agree with you in principle, but we are often advised/told to add extra items. In fact, if you'll take a look at the AoS FAQ on VJ ( http://www.visajourney.com/faq/k1k2visa-aos.html )

9. A copy of the petitioner's and/or intending immigrant's divorce documents. (If filing for a spouse, and one or both of you have been divorced before)

You'll note it is suggested that one include a copy of the petitioner's or beneficiary's divorce decree.

I double checked and tripled checked on the I-485 filing instructions and no where does it state that one should or needs to include either parties divorce decree(s).

I didn't include a copy with our AoS filing, as one was already submitted to USCIS with my I-129F petition, but that doesn't mean I'm going to suggest to others that they shouldn't include a copy. It's up to them. If they feel more comfortable sending in a copy of their divorce decree, then more power to them, even though I believe it's not needed.

I don't think it'll hurt the OPs chances at all if he includes his letter of explanation. USCIS can simply discard the letter if they so choose.
