Timeline

Hello,

 

I recently filed my IR1 application to the NVC along with the affadavit of support from my wife (my sponsor) and my father-in-law (joint sponsor). After some time, the NVC got back to me asking for extra documentation, including my wife's W2 and 1099 for last year. The issue is that my wife and I are both living in Canada, and her income exclusively came from a Canadian source, so she doesn't have any W2 or 1099 to provide. She filed her taxes to the IRS in March, but they have a huge backlog so they didn't process her paperwork yet. I messaged the NVC, but it will probably take them a couple weeks to reply.

Is there any other supporting document I can provide the NVC in lieu of the one they are asking?

No, just call their attention to the only source of income being Canadian.  You could call them.  Once you get through, the resolution should be pretty quick.

Facts are cheap...knowing how to use them is precious...

We had the same problem and got RFE asking to submit w2, but since we’ve lived in Japan we don’t have that! 
Is making it clear that the fact that w2 won’t apply to us due to foreign income enough for NVC to recognize their lack of understanding?

Update:

I called the NVC as pushbrk recommended. After 2h on the line, I talked to someone to whom I explained our situation. She told me to submit an explanation letter on ceac as a W2 or 1099. It will probably take them a couple weeks to get back to me...

Thinking more about the conversation on the phone, it sounds like if they see some money on line 1 or 2 of your tax return, they automatically request W2/1099. I didn't include the form 2555 when I originally submitted the documents. I wonder if it would have made a difference if I included that form along with the tax return.

NVC process is so stupid. 
I don’t know what form 2555 is but since that’s not what they were asking I’m pretty sure it wouldn’t have made a difference.

Did you also use public inquiry form to

ask about your RFE

This is basically how to report foreign earned income to the IRS with the appropriate deduction.

 

Yes I did use the public inquiry form. I just didn't see the point of waiting a month for them to answer when it's something that should be very simple...

When one submits a "tax return" instead of "tax return transcript" they must include all forms and schedules that would have been mailed if they filed by mail.  That would include any W2, or 1099 forms but also the form 2555.  This is your mistake.  Now, you have the solution.

Thanks for clarifying. I’m the applicant and not the US citizen sponsor so I didn’t know.

Wanted to share that just checked and confirmed that 2555 WAS attached and included in our tax return file we submitted altogether.
NVC still sent us RFE claiming they need W2/1099. It’s probably a stupid spec they decided they require but haven’t bothered to inform, like submit under this or that section instead of something else.

In that case, it's their mistake.  There are no W2's or 1099's to submit when all the income is foreign.
