I am currently living abroad with my fiance and no longer have a physical address in the United States, so I am worried about the "Intended Address" field for all the paperwork for the K-1 visa for my fiance.

 

From everything I read on here, most people seem to put their parents' address, but my parents passed away years ago, and I'm an only child. All of my friends live in a completely different state than the one I intend to move to, so I don't want it to look like I am up to something fishy if I put an address on all the forms and then show up at the airport (if approved) to fly into a totally different location.

 

Our plan, unless changed, is to stay in a hotel for a couple days while we shop around for a nice rental we both like, which I think is reasonable.

 

What should I do in this situation? Should I put the address of the hotel we intend to stay upon arrival?  Should I put my friend's address in a completely different state? Should I put "to be determined" on every form up until arrival? Do I have to fly back and actually lease something before filling out my paperwork... that sounds kind of extreme, but I really don't want to mess this up!

Yes.

 

Incidentally, how are you planning to handle the sponsorship requirement, considering that you live abroad and have no immediate relatives in the US?

Did you research the entire fiance process?  The marriage after entering the US, filling for AOS/EAD/AP, beneficiary not being able to work and having difficulties getting a driver's license until the EAD is approved, etc?

 

If you are living together it might be better to get married and do a spouse visa (CR1).

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1        
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)    
    Spouse can not work until she/he receives EAD (approx 6-8 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.
    A denied K-1 is sent back to USCIS to expire
  

CR-1
    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.

    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I am not sure what you mean. I would be my fiance's sponsor as I am  a US citizen and make plenty of income... I own an international business based in America and get paid in US dollars. I simply do not have a residential address there.

I have researched the fiance process up until the visa is approved. My real only concern is the "Intended address" on I-134,  DS-160 and the 'proof of domicile' for the affidavit of support. We're not really worried about my fiance working or getting a driver's licensee right away as my income will cover us both, and she plans to stay home with our newborn.

 

My situation is a bit strange because my company is based in the US and I am 100% owner of the company. I am paid W-2 wages from the company and all profits are passed to me as well. I still have a valid driver's license in the US, bank accounts, investment accounts, and substantial liquid assets etc. I pay taxes every year just like everyone else, and I maintain a PO box for all my US mailings. Before I left the US, I put all my stuff in storage... Basically what was supposed to be a 1 year trip kind of turned into a much longer multi-year trip... haha. I have never been employed in the country I'm staying in now.

 

I do not, however, have a physical address in the US and I know my PO box and commercial address would not qualify as you cannot live in either of those.

 

Surely, I am not the only person who has been in this situation?

He means "yes", you can enter "to be determined" for the intended address.

As long as both of you are aware of the limitations, then that's that.

 

Several of the posters here regretted doing K1 and instead wished they did CR1.  None so far have regretted the reverse.  The limitations hit home after the fiance arrives in the US and marry.  Not being able to drive hits particularly hard for some.  Not being able to run errands, get groceries, meet others to establish friendships (like a new mother's group), etc.  Wholly depending on the USC spouse and basically being stuck at home made them feel like being in a civilized prison.

 

The above depends on where people settle in the US. Downtown NYC, Chicago, Philly, Boston and a few other cities are fine for non commuters - things are in walking distance or the public transport system is comprehensive.  In all other places, a car is necessary for even basic things.

It depends. Putting down a friends random address and having no intention to live there borders on misrepresentation. It's a good idea to write a letter explaining your situation and what you actually intend to do when you get to the States. Do you intent to rent somewhere? If so, where, what city, what neighborhood even, etc. Have you contacted leasing offices? You need to show that you're really serious about returning to live in the US.

 

Contacting multiple leasing offices or landlords and starting an application would be a good start. Include that as part of your proof of domicile. Whether the embassy accepts this or not is their call. Some embassies are harder on domicile than others. Which country are you applying in?

I will be applying in Thailand.

 

 

Theoretically, I could fly to the US, rent a cheap apartment to obtain an address and then fly back to Thailand while I wait for the rest of the process. I feel like that would be a waste of money to have an empty apartment for 6 months to 2 years or however long it takes, as I don't want to to be away from my fiance for long. Our plan is to rent something for the first year while we house hunt, and then buy a house to ultimately live in forever.

 

I like the idea of writing a letter explaining the situation but I'm also worried it might complicate the process as well. Maybe I'll do as you suggest and contact a few leasing offices to see if they could perhaps offer me a deal of some sort... I have a feeling a lot of them won't even be able to fathom why I'd want to 'rent' an address so far in advance before I'm actually going to live in it. It sucks that my situation isn't that much different than a lot of people's but other people have their parent's address to put on the application... Literally not having living parents makes this super complicated, haha!

I think you can explain in your letter that you don't have any family members to fall back on, hence your plans to rent and you're putting in an address of a place you eventually intend to rent down the road.

You can maybe just contact some leasing offices and see if you can get "pre-approved" to rent a unit? Maybe have them draft something especially showing that, since you're not ready to move just yet. Sending in copies of emails back and forth between you and the leasing offices/landlords might even be enough! The Embassy will consider the totality of your intent to re-establish domicile evidence, so rent hunting correspondence plus other domicile proof could be enough.

 

I'm not sure which part of the process your at, but the "domicile" part actually comes later when you're at the NVC stage. So, if you're not there yet, don't worry about all the proof until you get there. If you're just at the first step with the I-129F petition, perhaps just put in an intended address of a rental property. I'm not sure if you'll need the explanation letter for the I-129F part, you might be able to just save that for when you get to the NVC/domicile stage. Nevertheless, all good things to be prepared for! :thumbs:
