Hi everyone I hope anyone can advice me or share any information would be so helpful , and much appreciated. 

I am the wife/ petitioner who live in the united statesThe spouse live overseas - Saudi Arabia we had our wedding cermoney on November 29th 2019 so menaning we are legally married and have an official marriage certificate, I only met him twice one month after the cermoney I came back to united states where I live and around march 2020 I decided to apply for his petition and we got our approval long story short he had his intrvew at riyadh embassy September the 7th 2021 and everything was completed and ok however he was missing one document so they gave him refusal notice under section 221g  so good thing his case is still on refusal and the status show its refused but I am not sure it might still be on AP and he didn't tell me anything or update that he gave them the missing document, so there is a chance he might sent the document and the case only going under administrative process and after he get the approval for visa.   My spouse tricked me and he is using me to enter the United States and to get a green card. I truly believed we were in real marriage  we only been married for less than 2 years and now after long distance relationship I recently found out  he been lying to me and this isn’t  a healthy and authentic relationship.He disappeared right after he attended the interview there is no communication between me and him until today he is not answering his phones or emails or anything. I reported this to both the Riyadh embassy in Saudi Arabia and NVC I SENT A REQUEST TO WITHDRAW MY PETITION AS SOON AS POSSIBLE TO BOTH EMBASSY AND NVC SIGNED UNDER MY NAME AND ALL THE REASONS FOR THIS REQUEST HOWEVER THE NVC ADVISED ME THE CAN HELP WITH THIS AND THE EMBASSY IS THE ONE CAN ASSIST ME THE EMBASSY EMAILED ME BACK AND TOLD ME THEY PUT A NOTE ON MY FILE SINCE THERE IS NO VISA ISSUED FOR HIM YET BUT THE CASE WILL SATY PENDING AND IT IS NOT WITHDRAW UNTIL NVC OFFICIAL CONTACT THEM. I ALSO REQUESTED THE EMBASSY TO RETURN HIS PASSPORT BEFORE ANY VISA APPROVAL AND THEY TOLD ME THTA THEY WILL SEND IT BACK TO HIM UPON MY REQUEST BUT WHEN I CHECKE THE STATUS OF HIS PASSPORT ONLINE IT SAYS THAT IT IS STILL WITH THE US EMBASSY. NOT SURE IF IT IS UPDATED BUT I AM VERY AFRAID THAT HE GET THE VISA APPROVAL AND COME TO THE STATES TO GET THE GREEN CARD I REALLY WANT TO AVOID ANY PROBLEMS AND STOP THIS PETITION PROGRESS BEFORE HE ENTER THE STATES AND THINGS GET MORE COMPLICATED. I TRIED TO CALL THE RIYADH EMBASSY AND THEY SAID THEY ONLY CAN BE CONTACTED BY EMAIL AND THEY WILL ANSWER THERE HOWEVER THEY DIDN'T GET BACK TO ME WITH ANY UPDATE FOR MY CASE.  THANKS FOR TAKING YOUR TIME TO READ ALL THIS AND THANK YOU IN ADVANCE

If the embassy already mailed you back, just wait. It's not like they will jump to his file and return his passport without the visa. Whoever got your message, they will put your email/withdrawal notice in his file. Whenever the CO reviews his file (could be today, next week or next month), will see your withdrawal intent and will not issue the visa.

 

Having said that, i hope you are making the correct steps and not responding as an outburst that you may regret.

 

May be it's the right step if you truly believe he was planning to just use you. I'd say follow up to the embassy's email again. Not sure how you put your withdrawal intent, i'd write a withdrawal letter with info of both person's, case ID, sign and date, scan it and attach while following up to the embassy's email just to make it more formal withdrawal.

Hello,

 

This is unfortunate.  Thankfully you discovered this now and not after your spouse immigrated.

 

Just be sure that your intuition/feeling are correct and not a temporary reaction to your spouse not contacting you.  That does sound very suspicious, but we have had posters here who withdrew petitions after a fight and regretted it a couple months later.  It seems your case took about a year and a half to process.  If the two of you get back together, then you will basically have to start all over with the process after the embassy denies this visa.

 

It looks like you did what's needed to withdraw you petition.  It is up to the embassy now to review the case.

It seems to me that you have properly withdrawn the petition and the I-864.  Thus, he has no grounds for a visa.  Good job!!!   Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

first i am very sorry for your heartbreak

i only hope you had proper information about him and you didn't act in haste

my Adil did not call me right after interview as he had to travel long distances to get to embassy and home

 

if he was using u,  u did the right thing and now must follow thru and divorce and move on

 

and even if the embassy was to issue the visa,  they can revoke it (happened to one man in Morocco)

again   i am so sorry for all that has happened to your marriage 

you are very lucky he did not come and then leave u and stick you with the I 864

Same thing happened to my friend/neighbor. Just like in your case the intending immigrant couldn’t be patient until they arrived in the land of milk and honey before the breakdown of the marriage. In his case it was a fact he had hidden from her about a medical condition. She promptly notified the embassy and at literally the last minute they terminated things.

 

You’ve taken the right steps. The embassy told her they’re on the side of the American citizen which will be same as in your case so I am confident they will pull the rug from under him.

 

Sorry your relationship didn’t work out.
