Hi everyone, I received an RFE today for multiple points. I am really confused because what they are asking for we have provided. 

 

Point 1: 

Based on the documents submitted, we could not determine that the petitioning sponsor, ______________, on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning

sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent of the federal poverty guideline for the sponsor’s household size. See Form I-864P for information on the Federal Poverty Guidelines. 

If the petitioning sponsor's income does not meet 125 percent of the federal poverty guideline for their household size, you must obtain a qualifying joint sponsor who demonstrates the ability to support you or

submit evidence of assets. See Form I-864 Instructions for more information. If you decide to obtain a different joint sponsor, you will need to:

Submit a completed and signed Form I-864, Affidavit of Support, from the joint sponsor. All pages must be present and of the latest edition date.

Provide the joint sponsor's Social Security Number on Form I-864.

Provide a complete and correctly calculated household size on Form I-864.

Submit a complete copy of the joint sponsor's Federal income tax return and all supporting tax

 

* We also had a joint sponsor because I was living abroad in 2020. Do I need to submit anything back regarding this?

 

Point 2: 

The joint sponsor on Form I-864, Affidavit of Support, must submit a complete Federal income tax return submitted to the Internal Revenue Service (IRS) for the most recent tax year. If you submit a transcript, it must

be a "Tax Return Transcript" from the IRS. 

 

If you were not required to file a Federal income tax return under U.S. tax law, attach a written explanation of why you are not required to file. See "Filing Requirements" in the IRS Form 1040 Filing Instructions to

determine whether you were required to file.

 

* We submitted our Joint Sponsors tax transcript for 2020. Should we resubmit? 

 

Point 3: 

Form I-485, Application to Register Permanent Residence or Adjust Status, was not signed by the applicant, ___________________________

 

Submit a properly completed and signed Form I-485. All pages must be present and of the latest edition date.

The latest edition of Form I-485 can be found at the USCIS website at www.uscis.gov.

 

* We definitely signed this. I made a copy prior to sending out and it was singed. Also, when we logged into our USCIS account the signed copy was uploaded by a USCIS employee. 

 

Point 4: 

The applicant,______________________ must submit a copy of their birth certificate issued by the appropriate civil authority in their country of birth. We will only accept a long-form birth certificate which lists

at least one parent.

 

If the document is in a foreign language, the applicant must include a full English translation along with a certification from the translator verifying that the translation is complete and accurate, and that

they are competent to translate from the foreign language to English.

 

* We submitted both version the short and long. These were also uploaded to our USCIS online account by an employee. My wife's birth certificate is from the UK and it looks to be hand written. It is a certified copy. Is this the problem? 

 

 

Please any help would be much appreciated. We are freaking out because everything they have asked for is there and has been uploaded to our online account by them.

It is indeed odd that they are asking for things you not just sent but actually can see online.

 

Funny enough, you can reply to the RFE online as well. Not sure if it would be worth sending them physically or uploading the documents.

 

There was a case recently where a member received an RFE for the medical examination and she just sent a letter telling them they already had the document.

Mind you, this was AFTER the interview. She was approved a few days later.

1. and 2. Regarding i864, list what you have provided as supporting docs to get proper guidance. Remember even if one doc is missing, you'll get generic RFE like that for i864. What did you provide for the petitioner and the joint sponsor? And what was the household size in each i864? Are you sure you provided tax return transcript?

 

3. I hope it was not signed by the petitioner, just in case.

 

4. Don't confuse them by providing both short and long form. 
 

Respond to the RFE per its directions. If it's telling you to mail to an address, do so.

This is what I submitted with my I-864:

 

    1. Explanation of 2020 Income
    2. I-864 Affidavit of Support
    3. Copy of 2020 US Tax Return 1040
    4. T4 Canadian Earning Statement (To show Foreign Income reported on 2020 US Taxes)
    5. Copy of 2019 Tax Transcript
    6. Copy of 2019 W-2
    7. Copy of 2019 T4 (Canadian Earnings Statement)
    8. Employment verification letter from current employer
    9. Job offer from current employer (Showing start date and annual income)
    10. Pay stubs from current employer from when I started to most recent
    11. Copy of Passport Biographic Page
    12. Copy of Birth Certificate
    13. Copy of Driver License
    14. Copy of Marriage Certificate
    15. Copy of Divorce Record from previous marriage

The I-465 was signed by my wife the applicant. Does the signature need to be printed out and legible
