Timeline

Hi,

 

My 2 K2s are in the process of being legally adopted by my husband, and supposedly they will be US Citizens after adoption.  I am preparing for my ROC next year - Should I still include them in my petition if they are already a US Citizen? Correct me if I'm wrong, that they will be US citizens when the adoption is finalized. Thank you for the response!

When they are citizens then no, but if the adoption is still pending when you file the ROC then yes include them until they fall off. I know in some immgration cases the adopting parent needs to cohabitate for two years before US immigration recognizes the adoption so you may need to wait for that to happen but you have likely already passed that point. 

 

I would pay the biometrics each and keep them on your case right up to the point they fall off after the adoption is final when they become citizens, also the adoption paperwork is great evidence for your (thiers) ROC.

Thank you so much. Yes, the adoption is almost final. My ROC is due November this year. So hopefully, they are already citizens by then.
