Hello everyone,

Thanks again for all the advice you all gave when I was applying as unmarried son to a green card holder.

I am now in the US but part of me is back home which is why I have some questions to know what to do and where to start please.

 

My child (4years old)

my child is on follow to join (on my application) but I am not sure of the following:

1) how long can I have my child on a follow to join?

2) can I change financial joint sponsor from my inlaw to my brother? If yes, how much does he need to earn to be a financial sponsor?

3) what documents will I need to present to the embassy and will there be an interview?


My girlfriend (mother of my child)

1) my girlfriend and I are now looking to get married but we are not sure if it is possible for that to happen now or how it will affect my greencard (I have not received the card just yet). Also can we have a wedding ceremony in the US or will it have to be in the UK?

2) She understands and agreed to let our child move to the US when I have put a things in place (like school etc) but she insist on coming to know where our child will be and what school she will be attending ("as a responsible parent"). My girlfriend has permanent residence in the UK which means she needs a visa but we are not sure if she can apply or if they will give her the visa for the purpose stated above. Any advice on this please?

3) my girlfriend will eventually join my child and I but we are not sure the best route to apply for her to do so when that time comes. I heard there is a route for fiancee visa and a route for spouse visa but we are not sure the route that will be best to use with less time knowing that our child would want to see mummy as often as possible.

As a permanent resident, you can only petition for your spouse (or child).  K-1 is only for US Citizen's fiance.

You can get married anywhere, the UK, the US, etc., you just have to follow the local laws with respect to getting a marriage properly certified.  You can get married in the US, but your girlfriend/fiancé will have to have a proper visa to enter the US, in her case a B2, then she can leave and you can file for the F2A visa.

Your gf is able to apply for a B2 visa to visit you, but she will need to show strong ties to UK.

 

The big issue is that B2 visa appointment.  It may take a year to get one.

The plastic green card is not your status. If you entered on an immigrant visa (as I presume you did from your statement that you are now in the US), you were a LPR as soon as it got stamped by CBP. If you read the bottom of the visa you’ll see it now acts as a temporary green card, for a year from your entry date.

Thank you all for your replies. It's a lot clearer now. 

Someone I was talking to said I won't be able to file for my gf and child even if we get married now until I have lived in Illinois for 5 months. Please how true is this?

 

Also I don't have a job yet and I am wondering if a joint sponsor will be allowed to cover the financial aspect (that is if I can file without living here for 5 months)?

Well that’s bizarre, who was this “someone”? There is no requirement to live any particular place for any amount of time to file an i130. If you want to, you can enter the US on your immigrant visa and file an i130 before you’ve even left the airport.

 

Yes, you can and must get a joint sponsor if you cannot show enough income yourself.

It's a friend of mine that lives here said so. Thanks for the info. 

We are going start planning our wedding and I will be back to get more info on filing please.

What are you waiting gc for? Your stamped immigrant visa serves as green card until your real one comes in the mail or up to a year whichever comes first. Go get married and return and file I-130 for spouse (include child as well but no separate I-130 necessary unde F2A category).

Hello everyone, I received my card thank you all for your continuous support.

 

Please I have a question. On one of the leaflet that came with my card (under  rights and responsibilities) says:

 

"As a lawful permanent resident you have certain responsibilities for example, you must

File taxes with Inland Revenue Services (IRS) to report your worldwide income and report foreign bank and financial accounts."

 

I asked my siblings what that mean and they said since I only got to the states end of september 2021, my card produced end of December 2021 and I only just recieved the card January 2022 there is no need to file any tax plus I am not working yet.

 

Please do I need to file any taxes if yes what am I filing with no income just yet?

 

If no, will I be breaking any law and will it affect filing for my family to join me?

 

My siblings have given some wrong answers in the past  that was corrected (I got proper understanding with the right answer from everyone here) on this forum is the reason I had to ask again.

Even if you file with zero income to report it will be useful as you show you’re following the rules. There are yearly free tax filing workshops done by local organizations - you should check that out.
