K-1 & K-3 Guide Update Request

There have been multiple discussions springing from the question of which affidavit of support to use for a K-1 or K-3 application. Many of us have looked and have been unable to find a Consulate that requires an I-864 for one of these non-immigrant visas. Several people also interpret the relevant law to read that an I-864 may *not* be required at post for a non-immigrant K visa.

Because of the confusion it causes, I'm suggesting that we limit the K Guides to only listing the I-134.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):

4. I-134 Affidavit of Support form. Ensure it is notarized (by a public notary), with all required supporting evidence. Some consulates may require a different form. Some require an I-864. If yours does, send that instead. You can call or email the consulate to check. Additionally, the consulate will notify your fiance(e) via mail correspondence which they prefer. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

I agree. The FAM is fairly clear on not requiring the I-864 for non-immigrant visas.
