Thank you for your response. I do not have the documents ready to file the I-360. Can I postpone this interview and then file I-360, and then have my I-485 in abeyance? In that case, my I-485 will still be pending, and I-360 will also be filed. Because I do not want to send a weaker case for I-360 and later receive RFEs.

If I file for I-360 by end of January/2022, with new I-485, I-765 (EAD), and I-131 (AP) together, can I still keep my EAD category as C9 (as I still will be married). Will I get my EAD in C9 category or will I have to file for C31 category.

Also, when should I expect me to get the EAD?

 

What I am terrified is to be financially dependent on someone as I do not have any family here.

It’s sad that you’re going through all this!but

you can do the following:

 

1- Gather all your necessary documents e.g marriage cert, pics together, joint bills. 

2- email yourself a copy of all e-media such as bruise pics, threatening messages, etc. change your email password or alternatively make a new one which your spouse does not know. 
3- Pack all necessary belongings in a single suitcase

4- Call police and say you are being abused(at the time it happens). Make sure they make a report.

5- Leave for a shelter.

you will get access to pro-bono immigration attorneys there. Begin filing your VAWA asap. 
6- Send an overnight carrier letter marked “urgent” with all your UScIS case numbers to your field office asking to hold the i485 because you’re going to file VAWA. Better if you still go to the interview and explain to them why you don’t have the letter and show them your online status saying your interview is scheduled( not sure if they will let you attend it, esp of your spouse is there too). 
7- once VAWA is filed, start divorce proceedings 

8- Attend therapy

9- you deserve a life of dignity and honor. Respect yourself enough to walk away

10- @sandranj is a lawyer, she is may take up your case if you request her. Other members like @Demise are very knowledgeable here and are your go-to resources. 
11- You can file for fee waiver for the applications

12- This too shall pass and along with you, we shall all be celebrating your victory whenever it happens. 
13- Good luck and best wishes. Keep on praying and working hard!

Hello.MY friend has a question:

How long does security check take for vawa? 360 was approved then approval was vacated and reconsider .(it was 2moths ago)when representative contacted to VSC ,  lawyer  received response that :. We will provide you with a decision on this case as soon as possible after the security checks are complete.  

is it possible ? applicant's background is clear and never had any problem. also uscis never asked any RFE  during in processing. 

HAVE YOU EVERE HAD SAME EXPERINECE? thanks

Your message brought tears to my eyes. I have been crying since the past 3 days. It has been so much of humiliation. I regret so much, and feel I made a mistake even coming here. Life was difficult back home but I was happy. 

I have a question: can I still go to the interview and request them to I will be filing VAWA and to keep my case on hold? Will they do that if I explain this to them or will they deny my case? Alternatively, I am thinking to just not go and let this be denied and then file I-360, I-485, I-765, and I-131 again; just worried if I will get EAD within 7-8 months as my EAD extension will expire in Aug-end of 2022. Please dont take me wrong when I say I want this to be denied. Its because I am so exhausted my eyes are hurting my head is hurting - i have taken 4 tablets (200mg each) of Advil so total 800mg just for headache. I feel so tired.

Hi Mahi,

Please take is easy. We all are on same boat. we all are/were suffered abuse. 

 

I have seen here on this forum people went to interview (without even VAWA application sent) and told the officer to hold the i-485. they were given 30 days. You can try that, however, it is all depend on the officer. 

 

If yo let this deny then you can not legally work until you get the new EAD

So you still go for the interview and request your i485 to be held in abeyance. This will save your current EAD and you will be able to work.

So with both scenarios factored out. Make a decision which seems best to you. Personally I went ahead for the interview and asked for my i485 to be held in interim. And it was. Vawa was already filed but I had no reciept yet.

I know that others say file ASAP, but I took my time and it took 6 months to gather everything that I needed and I did not have any RFE and was approved.  It is up to you and what you decide.

2018: Filed VAWA.

2020: Relocated to a different state and missed a letter that was mailed to my old address during the move. (Admittedly, my fault so I changed my address on file).

Throughout 2020 and 2021, I sent letters to USCIS pleading to resend this letter to my new address to no avail. I contacted my congressman to intervene with no help. I still don’t know what this letter entails till this day. 

2021: May - applied for EAD/AP renewal. It’s been over 6 months and still waiting.

 

September 2021: I received C31 EAD in the mail from my I-360. It’s been 3 months and I’m still waiting on the VAWA approval letter while my EAD/AP has been pending for over 6 months.
I-485 is still in biometrics/fingerprints status since 2018!! 😮😮 

Clearly, USCIS doesn’t process applications in sequence cos I’m seeing fast VAWA approvals here. I’m confused. 
 

Do I need to take any action or seek support from my congressman? 

Normally when you receive C31 EAD they will deny the C09 EAD.  It depends upon your local office when they will accept I-485.  Your time does not start in 2018, your time starts when your I-360 has been approved and transferred to NBC.

Sorry for asking you these questions. 

Which year was that?

Were people waiting more than 10 months to receive Ead/ap approval? or more than 2 months before receiving their receipt of notice of their application?

I think that people are reacting faster depending of the urgency of their cases and also how USCIS are dealing with cases today. 

Too much backlog and to much times taken nowaday to process cases. 

So,I do understand those saying act ASAP.

The process has become very tough today, even to get an EAD/AP.

 People were having this card usually 90 days after filing.
