Hey vj family. I am responding to a NOID I received. I don't have many pictures with me. USCIS is questioning the pictures I submitted that they are insufficient and taken on one place. How should I explain this ? My ex went with all the pictures in her phone and many pictures in my phones were just deleting themselves, I don't know what wrong with my phone. Also, I don't trust my lawyer, she seems not experienced in NOID. What should I do?

. @Demise. @sandranj

Can’t you just write an affidavit explaining why you do not have many pictures?

My RFE mentioned “insufficient photos” as well. I suggest that you check literally all your social media accounts and messengers for more photos. You can also try contacting your friends to see if they happen to have pics of you and your spouse, never know what they might find. One of my friends had super old photos of me and my spouse from like 3 years ago that I did not even know about. It ended up helping a lot.

if you filed 485 together before and submitted photos, other than the ones you provided for vawa, try submitting a FOIA request to pull those photos. They will be blurry and black &white, yet it’s better than nothing imho.

If none of these options work for you, you can re-submit the old photos with semi-detailed descriptions such as “ here is a photo of me and Mrs. X having lunch together at the Cheesecake Factory on 12/01/2018. We used to have dinner at this restaurant every month as Mrs. X  really liked their desserts” etc.. (if you have not already).

in the affidavit you would have to explain why the photos are missing the same way you explained it here.

I hope it helps a little bit

Get a copy of his birth certificate through vital records.

Not possible in Florida without his permission to obtain the certificate. I placed the order but they could not provide me the certificate without his notarized letter.     :(((((((((   Do you maybe have any other suggestion? Thank you

State voters registration. By using your spouse's DL or ID number and day of birth.

You should have something there.

Thank you. The description on the photo, should I write on top there with a pen or type a description on different page and attach it to every photo?

I would either type, or write in ink above each photo. The description sheet should work too, as long as it looks clear. That’s really up to what looks more neat/convenient in your opinion.

good luck!

Thank you so much. I will write on each in photo in caps so that the officer can straight look at the photo and description together

Yes 100% And they just won't give anything without his approval. I can't believe how hard it is to prove someone's citizenship, especially when they were born here 😕

Finally after 70 days of waiting i received my receipts for EAD and AP.

Man -- the joke worked FAST this time!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Form I-765, Form I-131, Copy of I-485 receipt notice, Copy front and back of your EAD.

That's all.

Contradictions without citations only make you look dumb.
