Hello. Vawa was approved in july 2021 and have my i485 interview scheduled for Dec 9. I have already it my marriage based i485 interview in march 2019 but at that time I was missing medicals which was submitted a week later. Would my medicals still be valid for the upcoming interview?

is covid vaccination also a requirement for the interview. How can applicants go about it if unvaccinated?

When I had my interview with my husband I submitted my Medical, before my interview I have received a notice that I am missing the Medical Document and IfI will be scheduled for an interview I will have to bring it with me. Did you receive such a letter?

From my knowledge the medical is good for 2 years.

When I was doing my Medical doctor asked me to provide the Covid Vaccination record, and it is required as of now, not sure how they do about people who are not vaccinated.

Its been a while since i was here, im a 2018 October filler and still nothing happened...crickets

Lawyer saying need to wait... paid twice for a work permit application due to her saying that some rules changed and 2 years so far and nothing, all i hear is that need to wait and if she will have news for me she will be the one reaching out to inform and pretty much not to bug her with this type of question.

I asked the lawyer recently if we are doing everything possible to somehow maybe expedite or at least get a freaking answer it just cant be only silence for that long... lately thinking more and more of just call it a good 15 year journey in us and just move to a different country in europe and leave everything behind...

Anyone here in same situation like mine?

By the way congratulations to everyone on their applications!

I'm a September 2018 filer and also nothing. I inquired with my congressman a bunch of times and every time I'm getting the same response - they are performing a background check on me and don't know when it will be over.

I thought of moving back to Europe too, but as long as I can renew my EAD I will stay here because I love my job and my company.

My advise for you is to contact your congress person and move forward with a congressional inquiry. You don't need your lawyer for that and it won't cost you anything. There's tons of information on congressional inquiry on internet so you should figure it out easily. Good luck!

Hello my family,

My interview for form I-130 is scheduled for 14/12/21 and am about to put in my VAWA application before then.

Please, I need your advice and experience to know If I should go to the interview or NOT because my wife won't go. I will submit my VAWA application after the interview ( 12/29/2021)

Hi

You're in the same situation I was in 2020.

My 2nd interview was scheduled and I was sure that my spouse will not attend.

Knowing fully well that this interview was highly based on the form I-130,

I didn't want to take any risk.

So, I filled immediately the I-360 and went alone to the interview  with a copy of the sent i-360 and the USPS proof that the form was received by the Vermont service center.

So, when I appeared on the interview day, as the officer was asking for the spouse, I immediately told her what happened and showed her those proofs. So, she went through my form I-485 if I  could correct some errors and then followed by the YES and NO questions only without anything relating to the form I-130. And then put my I-485 ON HOLD knowing well fully that the I-360 was just at its initial stage, for I asked her to do so.

My advice is to go alone to the interview with something to prove your spouse's absence and let the officer to know that something has been sent or about to be send to Vermont relating with a form I-360 (vawa).

I think you should go and let the officer know that you are going to file VAWA or you have filled VAWA already. have them hold your i-485.

I went to interview by myself and i told officer to hold i-485 and they did.

I am not sure if you can get student loan with PF.

But you can get financial aid with PF.

I never used it though.

I believe it is possible since I took one this August. I was able to do that after applying for financial aid and just got the Pell Grant.

I know that we have had several discussions about Prima Facie Determination, and that several believe that if they receive the letter that their VAWA will be approved.  I found the following information.

Prima facie eligibility determination is not a final determination which guarantees final approval of a petition.  The regulation provides that "[a] finding of prima facie eligibility does not relieve the petitioner of the burden of providing additional evidence in support of the petition and does not establish eligibility for the underlying petition." 8 C.F.R. § 204.2(e)(6)(ii).

A primafacie determination: (A) Shall not be considered evidence in support of the petition; (B) Shall not be construed to make a determination of the credibility or probative value of any evidence submitted along with that petition; and, (C) Shall not relieve the self-petitioner of his or her burden of complying with all of the evidentiary requirements .... 8 C.F.R. § 204.2( e)(6)(iv)(A)-(C).
