Vermont received my petition on November 19th. Do I have to send the receipt notice to them? To whom? The immigration officer yesterday refused to explain...to be honest, yesterday afternoon I cried no stop for the way she treated me...for no reason at all...

You keep the receipt for your record, the purpose of the receipt is only to inform you that your application was received by the USCIS.

You can download an app (ex: Case tracker, Lawfully) where you can add the receipt number and monitor so you know if there’s an update in case the mail gets lost.


After the forms are sent and received by USCIS, try to stay busy and don’t think much about it.(LESS ANXIETY)

 

Here at VJ we’re seeing 2 years for the I-360 and 2.5 years for I-485.

I can understand your feelings.

When i went to my interview i was treated the same way. You are not the only one. 

 

Once you get the receipt notice, i would say go back to same place and let them know your situation. Hopefully it would work.

I am sorry you felt that way too. I believe they enjoy their power...It is indecent.... We are not criminals but are treated as such only because born in a different country...

 

Thank you for your reply, but I do not think you can go back there without appointment. I already told the officer that I filed for vawa, only I did not have the receipt. I am really not sure what I am supposed to do. I asked her if I am supposed to go back to the office with the receipt. She just got upset. I don't understand if my EAD and travel parole are safe or not...

We haven't seen any jan 2020 approval on this forum yet neither December 2019 on this forum.

So far we have seen 2 to 3 November 2019 approvals.

I have filed my I-360 but I did not have the receipt notice yet. The officer told me, "we will hold the file for 30 days". I am not sure if that means that it is ok, that I am nit loosing my EAD. When I asked her to clarify, she got very upset.

 

I have a flight booked for my country next week (I have not been able to go back in years), but now I am scared that they will revoke my documents while I am away.

Once you receive your I-360 receipt you must write and sent  (USPS tracking to proof it was received) a letter to your USCIS local office where you had your interview. The letter is to request your I-485 to be hold on abeyance until adjudication of your pending I-360,  In the letter include your Name, Address, Forms # I-485, Case #, Alien #  it should be a straight forward letter dear USCIS Officer Enclose is my I-360 receipt as proof of a pending Vawa case, with this letter I will like to request my form I-485, (I-765/I131) to be held on abeyance, etc.... I will also include a copy of your I-485 receipt and copy of your ID for identity verification.....

* Please note the officer can deny I-485 even thought you sent your I-360 if it is deny simply file a new I-485 Package with Vermont Services Center*

*I will suggest your to hold your Travel plans until i-360 is receipt is received and you sent the letter to the local office. *

I already sent a letter to the address where I had the interview before the interview, with the exact same information you said, except without Receipt Notice of VAWA, as I do not have one yet. At the interview, the immigration officer did not act like she knew of the letter I had sent, but who knows... So I guess I should send the letter again and include the receipt notice once I receive it?

 

How will I know if then they accept to hold in abeyance and save my documents or not? 

 

And I really do not know how to break my mother's heart. She has been waiting 3 years to see me. None of this makes sense, I got my EAD after 10 months and as soon as I got it I was called for the interview. Did not even have the time to actually use this EAD. I was hoping to at least get the time to see my mother for Christmas...

Hi @FeDaniela

I got my interview scheduled for January 2020, my attorney at the time told me not to attend and he wrote a letter saying that I couldn’t attend the interview because I had a family meeting, he said that was to give me time to file for vawa.

I think around February I received a letter from USCIS saying that my I-130 was denied because the reason was not valid.

My I-485 is on “Interview was scheduled” since then and I’ve renewed EADs multiple times under “C9”.

Do you think that my I-485 is still at the local office and when my I-360 is approved they will schedule another interview?

Since you already had your interview, and the officer said she will hold I-485 for 30 days. This 30 days hold is to received from you I-360 receipt. you mentioned previously just sent a request to hold letter, maybe your I-485 was not even in the local office yet, and it was misplace USCIS do not give much explanation, but now the interview was conduct and you have 30 days please submit the 

I-360 receipt, They do not updated if they put on hold, you will know one you renew your EAD or if you inquiry thru congressman.

It seem that your I-485 is held, this is the reason you keep renewing your EAD C9, Once your I-360 is approved Vermont will transfer your file to NBC (they make sure your file is complete with all documents) and NBC will sent to local office the officer will consider if interview is need it or waived usually if they request I-693 means interview will be waived and thats all they need it.
