Hello,

Has anyone here file N-400 form online successfully with approved vawa case? I am going to file N-400 soon, but don’t know I have to file by mail or can file online as other cases.

You answer is really appreciated.

Thank you.

I think yes. There is another VAWA member who asked the same question in a separate thread. You may search the broader forum for “VAWA and N400” to find that post.

Hi guys, I need some advice here.

I have a pending I-130/I-485 (filed Nov 2020) sitting at my local field office ready for my GC interview. However, as of Sept 2021 I moved out and separated from my abuser. On Nov 5 2021 I filed my I-360 to Vermont and mailed a letter to my local field office to request them to hold my current I-485 in abeyance. I already have my EAD.

In my I-360 package, I have only submitted my personal declaration, a 2 page affidavit from my usual therapist that talked about my abuses/trauma, and her professional opinion on how that has affected my physical and mental safety, a screen shot convo between abuser and I where the abuser kicked me out of the house / made me to sleep outside (which I expanded on my explanation in my personal declaration). I am waiting for my police clearance records to come in and meanwhile, I am engaging a psychiatrist who is trained and specializes in performing immigration VAWA psych eval to complement my existing pool of evidence (which is very little). I will be submitting my police clearance record and the complementary psych eval later on when I receive my RFE.

I was mainly abused emotionally and mentally and therefore do not have any physical wounds to show for. I have no family and friends here so I have never told anyone and therefore no affidavits from people and I have never reported her abuses to police.

My question is, do I have sufficient strong evidence to prove 'extreme cruelty' on grounds of mental/emotional abuse?

Abuse proofs are mostly in written affidavits, so your declaration, psychiatrist evaluation and any other proof will work.  For my case i had only psychiatrist evaluation as a proof of abuse. I did not get any RFE on abuse part but i did get REF on Good Fair Marriage.

I think your personally affidavit will have effect too, make sure you write everything in detail from the day you saw each other first time to now.

and send what you have and they will ask more if they need anything.

Good Luck

I-864W Is a very complex form you can fill out on your own:

Part 1 is your personal information (Name, Address, DOB, Country of Birth Etc)

Part 2 (Choose the one you are using to be EXEMPT  in Vawa case is: 1d. You are filling an immigrant visa or Adjustment of status base battered spouse I-360)

Part 3. 1a you read and understand English, lines 3.4.5 your phone number, email.  Line 6a your signature and date (don't forget to sign)

Part 4, 5,  (no need if you are the one filling it and knows English.

Part 6 (if you want to put any additional information (is just if you need)

Hey vj family. The person who did my EB2 visa application made a mistake on my marital status. He put single instead of married. At the consulate the day of the interview, the officer didn't ask me if I was married or single for me to change that.

Now USCIS is asking me to clarify that. Is this Misrepresention? I received a long NOID that is due in 33 days. I have a 204c fraud on record based on i130. Now Vermont ask me to clarify many points in this NOID. also what should I include in my personal statement about courtship?

Hi, I recently filed my I 485. In the part 8 question 16, I answered no to if I’ve ever worked in the US.

Prior to filing my I 485, I had applied for ITIN. I just received my ITIN number today. Can I still use the ITIN for business? Is that going to affect my I 485? What do I do?
@demise, @sandranj pls I need your response.
