I’m May 2019, still waiting with 4 prima facia. Which is to expire this November. Yep I’m broke, sick and can’t do anything to help myself. I hope it gets better soon.

What and when was your last update?

You are not obligate to renew C31, you only need one EAD to work you can choose either both, But I recommend C09, for my personal experience C31 seems to take longer to be validated on some state agency like DMV, Medicaid etc.... C09 is better for me.

Great, thank you!

I was hoping to renew c9, especially since it’s for 2 years now if I am not mistaken.

In my interview, the IO did not specifically ask about the physical abuse, but asked about the financial abuse and the threats of deportation.  Refusal to give me my SSN and GC.

Oh wow, thank you for your advice, that is what I am scared of.... When was your interview and what happened next?

Do Not go to the interview without a lawyer. Especially if you had a second interview, and they have doubts about your marriage. I recently had an interview in Pittsburgh, and it was a total crash. I went there by myself, thinking it will not be hard. Brought my taxes, all papers. But the officer didn't care about my taxes, he said that he doesn't need them. All he cared about was to break me or bring me to the breaking point. He start questioning me from the day 1 I came to the US, how I met my husband, why didn't I go back when my marriage didn't work, that I am a bad mom, since my kids are in my country, and I don't care about them. I was in shock. He started blaming me that I am from the Russian community, who pretty good knows how to prepare papers and fool migration. I never heard about such an interview. It was a lot. He kept me for more than an hour, with his blaming game. I was trying to answer him also, but since I was alone, I couldn't tell him you have no right to talk to me like this. I was afraid he could do something worse and just tried to give answers. He told most of you migrants do these, thinking that we are in USCIS here all stupid, but we are not. bla bla bla. In the end, he told me he doesn't believe me, even my case was approved in Vermont and he has to investigate it. It has been 2 months since my interview day, and I still didn't get an answer from USCIS. So my advice, do not go there without a lawyer. It is better to have a show watcher than become a show victim of some officer, who hates migrants.

OMG KAMA!!! I am so sorry you had to go thru this! This is unacceptable!

Thank you for sharing your story. I think that having a lawyer is a wise decision. As you say, especially that they already doubted my marriage, they "invited" me for the second interview with my husband... with cameras!!! The 1st interview with my husband was awful and the IO was so detailed and noisy that I just don't  comfortable going there by myself. Even tho many say that VAWA interview it is a short, easy interview. But it is about my life, getting the green card or not... and what I and you and all of us have been thru... My marriage was a nightmare;  I don't think it is worth it to risk it. Yes it can be additional $300-$$1000 to pay the lawyer, but I believe it is worth it.

You mentioned " I was trying to answer him also, but since I was alone, I couldn't tell him you have no right to talk to me like this. I was afraid he could do something worse and just tried to give answers."

Thats the thing, we can tell the IO that they have NO RIGHT to ask us those questions, but we feel too intimidated; it is too stressfull, because they have our lives in their hands... All cameras on us and this one person, an IO decides about our future.... I hope you get your Green Card soon! Did you have a lawyer at all?? To prepare your case?

Why not send an AR-11? I changed my address trough AR-11 and online as well like 5-6 months ago. I am still not sure uscis updated my address, it is so frustrating and my congressman said he can't inquiry for the address check. what should i send them?

The officer screwed up big time when he/she changed your address online, it's prohibited by Law.

It looks like my spouse is determined to sabotage my immigration status. I’m suspecting they will withdraw my I-864. (I have a pending I-485, no I-130 since I was K1 holder)

I’m terrified because, from my understanding, my C09 based work permit will be immediately voided once USCIS receives the I-864 withdrawal letter and deny my I-485. Should I file VAWA right now and let the field office know? Will they hold it in abeyance even before the interview is scheduled? If I lose my work permit now, I can’t wait without work authorization another several years to get it back until my VAWA is approved. Please help.

If your spouse withdraws forms I-130/I-864  then  immigration can't put your I-485  on hold, in case of denial just refile  your AOS.

The hardest thing in the world is to attend your interview, be subjected to stress from the interviewer, and keep your wits about you.  Depending on what happens, some ideas are:

-- politely say that the I-360 has already been adjudicated, and "can we please focus on the I-485?"

-- startle the interviewer by saying sincerely, "I'm sorry if you're having a bad day."

-- if all else fails, state politely but firmly, "I ask that your supervisor join us here, now."  Repeat this.

You are 100% correct my friend.

Actually I was thinking about that too, Do people sue immigration officers at all?

I am having the VAWA interview, and I was thinking what happens when they start asking questions not related to the I 485, like the VAWA case.

Probably nothing happens to them, but was just wondering if people ever sue IO lol 😆

If you don't feel comfortable talking about the abuse you can say to the officer "I am not comfortable talking about  the abuse that  I endured", if he/she insists then say  that Vermont adjudicated  you I-360 and you won't discuss about the abuse.

Hello VAWA community, i'm VAWA applicant and i want to renew my Work Authorization and Advance Parole and my lawyers is asking me for $1000 fee. I'm looking to file by myself and found everything that i need, i just want to ask is there any consequence that can happen if i file by myself and not including the lawyer on the application documents, since he is on the application docs for my VAWA and i-485?
Looking for advice.

Thank you

There is no consequences for you if you decide to file the forms, but your attorney might be  annoyed, just tell your attorney that you are filing form I-765 because you don't have the money to pay his fees.

Just got a case status update of card production on my i360 case. I presume it's a C31 EAD, but won't celebrate yet as USCIS is known to make mistakes on the online system. As the British say, there is many a slip between the cup and the lip. I360 receipt date Nov 12, 2019.

Congratulations.

I am very happy for you.
