Guys update on my EAD renewal - today is my first day I can’t work and my job put me on a leave of absence.

On another note, I heard back from the senator that they inquired from the agency on my behalf about the ead yesterday. So here we are. No news yet.

Applied for renewal May 6, 2021.

Have your HR gave you any documents? have you present those to your congress/Senator?

If you have not then i would say get a letter from your HR and try to expedite through your senator and also send a copy to Vermont. Reach out to ombudsman as well.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

You don't have to submit any proof regarding the abuse suffered when you will apply for naturalization.

Contact your congressperson to inquire on your behalf.

Thank you.i have done that twice, regarding my VAWA case one in June 2021 and then December  2021, first time they said case was received in November 2020, rather then in May 2019, even though I did get receipts and Prima facia in June 2019, stating that case was received in May 2019.

then asked to inquire 2nd time, and February 15 2022, they said case is under review with an officer, I am confused, hopefully they decide something soon,.

If there wasn’t any convincing evidence to start with, I don’t think it would have been approved. The lawyer needs to quit being unnecessarily flippant! I didn’t have a police report, so many people didn’t either and were approved. Speaking about police report are you referring to the one from the abuse et al or good moral character requirement? I had one for the GMC not for the abuse. Remember that the pace is different for each case. Don’t let your imagination run too wild. 👍😊

Thank u @Stillwinning!!!😊 yes I have one for morals but not the abuse. Okay thank u love

So I am just trying to get a sense of timeline here per current trend.

My I-360 was received by VSC on 11/8/21 and they sent out their receipt notice on 12/2/2021. I have not heard next steps since then. I am expecting RFE (I need to include good moral character docs (aka police clearance), and a detailed psych eval report) however.

My question is since I have not heard back from them the last 5 months, I am assuming the next step in the process after sending me the receipt notice is either a RFE or a Prima Facie determination? If I am right, what is the average time line to anticipate before I receive the next communication material from them.

If anyone can give me a general breakdown of a timeline between each steps, that will be perfect. Thank you.

I did apply after 2 years and 9 months. It is mandatory to have proof of your marital status either the marriage certificate or divorce decree, if you don't submit it and it is on the list of documents to bring to the interview.

Please find the memo in this link. https://www.uscis.gov/sites/default/files/document/memos/sec319a012705.pdf

So I have a question since our marriage were terminated due to abuse can we get married again before becoming a US citizen and do we have to submit our tax return with the us citizenship

You don't need to submit your tax returns but you should bring them with you to the interview, some officers do ask for it.  They did not ask me at all, but my friend was asked for hers at her interview so it depends on the officer.

I don't know if getting married would have any effect on your eligibility, I doubt it but do consult an attorney just to be sure.

Honestly speaking there are no time line.

next you might get Prima Facia. However, there are people on this forum who never received Prima Facia.

If you really need Prima Facia you can always request that either writing or through your congress/senator person.

You can RFE at any point of this process.

If you have not sent good moral character certificate they will request that other than that they might not ask for anything or they might request additional evidence.

So just be patient and keep yourself busy doing something productive. This process might somewhere 20 to 30 months. Be prepared for that.

When you get your green card through vawa, you remain under vawa eligibility even after et new marriage. Unless you had proceeded for a changed green card eligibility after your marriage before filing for citizenship.

But I guess this will not be wise for anyone to do so.

Yeah, I do not really need PF. I have a well paying job thru my EAD (got my EAD thru I-130/I-485 prior to filing for 360).

So it sounds like it could jump from receipt notice to (RFE) adjudication decision as the next step if they wanted to.

yes that is true. It could be anything .

Just make sure keep renewing your EAD on timely manner so you do not struggle or loss your job.
