07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Good day everyone I would like to get some clarification on tax return. 
I had a joint sponsor from my previous marriage based adjustment of status application before filing for Vawa last year. I recently was granted EAD and AP (got my EAD last week) from my previous application while my i-485 has been kept in abeyance. 
I currently live with my friend (joint sponsor) as she has been providing food and shelter. Can my joint sponsor claim me as a dependent in her tax return application ?

What's your relation with friend? 

 

If just a friend then no your friend can not claim you.

If I were you I would plan on how to go into hiding. Move, change my phone number or block him. 

You have decided to go the VAWA way, at this point you don't need him at all, at all.

I would also stop figuring out how to talk to him. You honestly don't owe him an explanation. Just move on with your life. Focus on yourself and your daughter.

The evidence you have is good. Use all the hospital evidence, the therapy you already attended, plus the new one you want to start. Also your story should be very detailed, don't leave out anything.

Most importantly stop thinking about him and worrying about him. He didn't care about you when you were hurting and scared.

Move on and let him fill in the blank. Don't worry about explaining anything to him.

The tax return 2022 is based on your 2021 income. 

So, if in 2021 you did not have any social security number , no body can claim you.  because they need your social in order to do so. 

If the person is just a friend, that will be impossible.

If he is your spouse or blood related like your family member, YES. in condition that you would have had your social in 2021.

To avoid people using you to make their money, I will advice you to file your tax return in your own name next year with your own W2 or 1099.

I'm a tax preparer.

Yes, if you meet the requirements of a dependent, that means your friend provided for your living needs all year in 2021.

Thank you for responding to my question. I’ve just received my EAD & SSN 2 weeks ago so she’s been responsible for my welfare since I moved in with her in late 2020 up until now. What the requirements if i May ask?

If you lived there the entire year 12 months, and made less than 4300.00, she can claim you.  You do not have to be a relative to be claimed as a dependent.

I agree with the beware of people using your information, but I think this is different as she has been living with this person who has been providing her financial care for more than 1 year.
