Can you realistically get medicaid via VAWA? I tried with an approved I-360 and was denied on the basis that I entered after 8/21/1996 and because I haven't been a "qualified alien" for 5+ years. I went digging and looks that determination was correct.

Hi everyone, 

 

im sitting up at 2am having extreme anxiety. I was listening to some old audios I had saved I’ve realized I’ve lost a lot of them I had recorded. I do have one that he is super drunk screaming at me on the street and he pushes me - you hear me say don’t push/touch me (he wasn’t actually physically abusive more mentally but this is one the one he grabbed me - it wasn’t hard though.

 

Some of the audios were really hard to listen too. It wasn’t so much about him screaming it was the ones where I just sound so sad. I was so heartbroken. He changed so much after I married him. I was really devastated and hoped so much it was just from the pandemic but now I hear that I was just blind

 

I’m trying to find text messages where he is threatening to deport me/divorce me but I only have most of them from after I asked him to leave - most of the times he would say it was verbally and same with when he yelled. He didn’t do it too often via sms. 
 

im worried I don’t have enough evidence. My daughter saw me crying before and she knows what’s going on and she said she would come vouch for me in court. She knows how repressed we were and especially me when we lived together. she told me I was the most patient person she ever met one time after he finished yelling at me and I just nodded to him apologising not to make him think like he lost to keep the peace. She said if she was me she would have thrown his things out on the street months ago but she knew at the time I was keeping quiet over fear of him pulling the visa. 
 

The problem was most of our friends didn’t see him like I did. They saw he was mean and very unsupportive but they never saw him yell. None of my family live here but I have my dad and my best friend in my home country as some sort of proof as they both heard him on the phone. I never called the cops (again fear of deportation) and my therapist resigned but I do have proof of medical stress (admitted into ER for seizures) and hair loss too (dermatologists) and that I went to the therapists, just no letter from him. 

His ex wife will probably help me too. He as married to her before me, he did the same thing except she ran back to her home country and refused to come back and he pulled her visa out of spite. She sent me a lot of their emails - he was awful to her too. He told me she went crazy and never to trust her. 
 

her and I both have a theory that he really wants his EU permit/visa even though I am a dual citizenship in New Zealand too. And he never once wanted the NZ visa  (Born there but my family is from Italy and France) 

 

Could you also help me what I can say to him without him knowing I’m applying for VAWA? 
i don’t want to make him too angry. He keeps asking when he can come around so we can make a plan about taxes etc but I don’t want to see him. He keeps saying if I don’t respond he will file for divorce on Monday. I haven’t replied but I need to say something like:

 

I will not be threatened by you anymore. Your lack of respect towards my daughter and I won’t be tolerated anymore. I will be dealing with my visa independently now. I will let you know a time when I am not home for you to come and get the rest of your things.  (I’m leaving in 8 days to go back to my family for a couple weeks so my friend will let him in) 

 

i kept my mouth closed for so long with him I want him to see his outbursts won’t be tolerated anymore. I stayed so friendly to him since I left because I was scared of him pulling the visa. Even when I got him to leave I had to do it in a way where I took all the blame and gave him hope I would realize my errors and take him back (I convinced him to give me space and he only said yes if I promised to start filling out the paperwork for the Europe visas) It was all I could do to keep him from losing it. But now he knows I’m not complying with him anymore. Which is why he won’t stop texting me and tell me he is filing and pulling by Monday. He knows I haven’t done any paperwork for him. He can’t dangle the threat of deporting my child and I over us anymore 

and he can’t control me anymore.

Thankyou. I actually just found the guideline list for what evidence I need and I think with my self letter, some letters from my family and friends about my good nature and also a couple of them mentioning what they heard, my medical and therapy records I might be okay. 
 

I’m still not sure what to say to him though so he knows I don’t need to deal with him anymore.

I have to go get a psychological evaluation I never had one (my therapist didn’t do it though he was my therapist for 4 years) 

I have my neurological analysis but I never mentioned any of the abuse to him though they did try and pry it out of me what stress I was under while they did all the tests after the seizures (I couldn’t exactly say my husband I had only just got married -  though he never came with me to a single medical appointment not even when I had to go see my doctor about my cancer test results. 
 

He actually didn’t have an ounce of empathy in his bones. Anyone who sees their wife cry because she got a letter saying urgent doctor trying to get in contact with you about abnormal result (my first cancer scare) and looks her straight in the eye and instead of saying are you okay? Or what did the letter say? Anyone who looks bothered and says “are you helping me carry this dip or not?” instead of all that Is a real bad person. 
 

Man I had blocked so many things out. And yet here I am feeling guilty about applying for VAWAand that he is going to feel mad when he finds out he can’t threaten me anymore. Sometimes I’m still in that mindset of being trapped

 

finding VAWA will allow me my freedom after everything I dealt with.

I have a similar timeline. Applied on November 2019, RFE  end of December same year and no prima facie. 😕

I think your approval will come soon. I applied on Nov 2019. No prima facia. only one RFE and on November I received the "card in production" message and on January 26 I received the approval.

I received the EAD under C31 category on november/2021 15 days after the card in production message.

 

Regarding the EAD renewal under C09, i have never received the card.
