Plz help if you have any info, it’s urgent,

 

I read that a petitioner can submit the vawa petition or do the interview and immigration visa through the U.S embassy in the home country or the U.S embassy in the country where the petitioner have a “legal residency” 

 

Is being on a visa (such as a student/work visa) in a third country that isn’t the home country considered a legal residency where I can do my interview at or receive my vawa based immigration visa?

 

if anyone can advise with any helpful info or knows who I can ask such questions or if there’s another thread to help me answer this question because I might need to move outta my country as soon as possible for safety reasons.

What is the probability for USCIS to still be sending an RFE after 23 months of waiting?

In another word, is there many peoples after having at least three prima facie and after waiting for more than 23 months can still be issued an RFE ?

Hey rhema, 

 

a prima facie is a document issued that only means that USCIS has all the minimum required documents for your case and will be considering the evidence provided. It can be used to apply for some social assistance programs that help when in very difficult circumstances that victims of abuse find themselves in. 
not everyone gets a prima facie- I never got one and my case was approved. It has nothing to do with your chances of getting approved or not. 
 

RFE- can be issued for any reason the officer sees fit- if they have a question and/or need more evidence, they issue RFE to give the petitioner a chance to provide the same.

I think you misunderstood her\his question. she’s asking about the chances of getting an RFE even after waiting 23+ months with no updates or an RFE . She means is it possible that someone would wait 23+ months and still get an RFE after? I think the answer is it depends on each case and if USCIS needs further documentation or explanation regarding a certain point.

I know what she means, and yes, RFE can be issued at any time.  Thanks for further clarifying the point :)

You answered with the definition of RFE and PF so I assumed you misunderstood the intended question, my apologies..

They can issue a RFE multiple times prior to petition approval.  There is no timeframe cut off for a RFE.  

 

As stated previously having PF has not impact on the adjudication of your petition.

Hey I’m also same page so I got RFE after passing 23 months pending Vawa case and I  responded it. 199 days ago they received it and no decision yet , rfe was asking me good moral and recent marital status. By the way I have 4th prima facia .

thats unusual they asked for recent martial status? how come?

I am past 32 months marks, Filled in May 2019, received my Third Prima Facia last month after requesting it, There hasn't been any update, no RFE

I do hope we all hear good new soon.

Like Pinkrlion said, you can get an RFE at any time and while somewhat unusual it's not unheard of for VAWA cases to receive two RFEs or an RFE and a NOID before a decision is made. Hell, you can even get an RFE after an approval but at that point it's called a NOIR, though these are super rare and I've never seen one in person.

 

It all really depends when the case actually crosses an officer's desk. My own got RFE'd like 18 months in and wasn't approved until 27 months in.

Contradictions without citations only make you look dumb.

Your case is already out of the processing time, you should inquire. We have been seeing many winter 2019 approvals so yours should be inquired about.
