You are wrong . The person MUST send form I-765 to Vermont.

6 months. Vawa is taking 17/19 months to be adjudicated.

my 360 was approved 12/2020

485 was applied oct 2018

i am in Newark NJ 

Newark local office  is taking  9/12 months to set up the AOS interview.

Your  information is incorrect,  to avoid a notice to appear in Court ( NTA) she must send a copy of the I-485 receipt to the local  asking them  not to issue the NTA.

You can travel to any Country you want, if you  don't have an asylum case pending or had before, or if you  are in removal proceedings.

Hi @sandranj

Thank you for your advise. Can it be a normal letter along with the receipts or should I still file the I-290B along with the letter? I'm worried if they might ignore the letter again, just like they did with the freeze letters, and still issue me an NTA. Will the letter suffice. Attorney is saying we need to file 290B with NBC (That's where the denial came from, my file is at NBC) and she said nothing about sending a letter to the local field office. Please advise. Thanks a lot.

Attorney insists that we should file a 290B. They're saying it's for the best because the uscis shouldn't have denied the application when we sent the hold in abeyance letters to transfer the case from 130 to 360. They're not even charging me for the motion and that they just want protect me from all ends.

 

@Demise we did send hold in abeyance letters to transfer the old 485 to the new one but the uscis ignored them. We filed the new 485 and 765 because attorney was doubtful that they might do this, and if it happens I'll be safe regardless.

 

I don't know... I'm confused.

I don't know if your attorney is trying to scam you or if he/she doesn't have a clue about VAWA Law.

You have a pending I-485 why do want to file the I-290B?. If they issue the NTA, you just go to the hearing, it's not a big deal.

I want to avoid getting an NTA. I cannot handle being put into immigration proceedings at this point in my life, I'm struggling every day. They're saying 290B will bring USCIS' attention to the pending I-485 application and you won't be issued an NTA. They haven't mentioned anything about sending anything to the local office. My file is not at the local office for sure because the denial came from NBC. Do we still need to send something to the local office. And thanks thanks thanks for your help. (L)
