You have to send the letter to the local office, usually they hold the case when the person attends the interview, but you won't have the interview because the I-130 was denied, but just  in case send a letter to the NBC as well.

You don't have to file a new I-485 because your I-485 is pending.

C09. If you want to renew the advance parole you have to refile. Submit a copy of the EAD and AP, passport pictures , a copy of the I-485 receipt, copy of the I-94. If you had the fees waived before then you must file a new I-912.

It seems they approved your case.You mentioned that you file form I-485, did you have a I-485 pending before filing a new one? if yes then the interview should be regarding the first I-485, if not then they approved you VAWA.

They take 30/45 days to send you the receipts.

My attorney submitted the VAWA for me on January 22 2020 while I was in California, did the biometrics in February 2020 and received the prima facie March 2020. I was afraid to lose my parents before seeing them, so I contacted my attorney and she told me that i cannot apply for an advance parole before my I-360 was approved. But I can still process my case through consular processing with the US embassy in the home country. The struggle was real at this point with my abusive spouse and the fear of losing my parents. I had to leave the States so I can be with my parents who passed away few months after i arrived home. I already regret not seeing them for years so that short time seeing them was worth it. 

 

I contacted my attorney to ask her how I can process my case through the embassy. But she said all I can do is wait. Couple months after, she told me that the vawa program she has was not funded anymore and she cannot represent us anymore, so all the clients have to look for a new attorney. I was referred to her friend who is a vawa representing attorney, and she agreed to represent me and pay her when she does any work for me since all the papers were already filed and there’s no work left. So all she can do is receive any notices mailed by USCIS. So on November 20 2021 my case got updated to “name was updated” and that’s about it. No more update on my case. So every time I ask her a question, she tells me that I have to pay $250 for a consultation. 

 

I am dealing with death threats for honor killing  as a female, and I’m not safe here back home and after my dad passed away things just got worse because he was the only one protecting me. so being in the US I was away from death threats before ending up with an abusive spouse and him knowing I have no support did not help at all. 

 

Now I want to ask if anyone is dealing with a pending vawa outside the US and waiting for approval to go through the consular processing, or even dealing with something similar as me? and if this will affect my case in anyway. Is there any way I can get any updates or details on my case? Or if there’s a way I can get my case processed faster? Or if I can contact a Congressman in the US or a tier 2 agent from abroad. Is there anyway I can go back to the States even if my vawa is still pending?

 

Any information can help, I’ve been traumatized, depressed, and struggling trying to be stress free and settle down somewhere safe. 

 

If you traveled with advance parole and the advance parole is valid you can return to the U. S. Your congressperson can contact USCIS on your behalf, but the chance that they will  expedite your case is  slim.Good luck.

Hello Sandra @sandranj and Everyone, 

My i360 was approved 2 years ago ( January 2020) and there is no update since then . I dont know if my case was ever transferred to local office(nyc). I contacted congress many times and I receive the same answer from uscis - security check.. Senate - never responded with the answer ,still pending. I went to info pass to ask where my case is and if any updates- the answer was " we can't tell you that information" ,so they didn't give any information at all. What are my other options ?What would you recommend ?

But my i485 is closed administratively and they said i can write a request to request for reopen again once my vawa is approved

I currently hold a C09 EAD (and AP) and still married to USC. VAWA has been filed. I-485 (fees paid) and I-130 is still pending and 485 was requested to be held on abeyance thru writing to my local office (though no official letter confirmation was ever sent to me to confirm the abeyance). My question is, if a divorce happens now, can I still renew my EAD under C09, fee-free, based upon I-485?

 

And when a divorce happens, what happens to my current I-485 and I-130 and how does that affect my I-360 and its adjustment of status (upon approval of I-360) based upon the current I-485 that was filed by my USC spouse.

First of all, happy new year!! I’ve been a silent reader for years and this forum has been keeping me sane and hopeful, so thank you all for that 🤍

 

I got married to a US Citizen in 2017, I’ve submitted my I-485 in October 2017 but my marriage ended before our interview. I went to the interview and asked for my I-485 to be held in abeyance, which they did. 
 

I’ve applied for VAWA in March 2019 and my I-360 was finally approved in August 2021. This week they transferred my I-485 from NBC to Vermont for “faster processing” but from what I’ve been reading here, it’s usually the opposite. Does anyone know why they transferred it to Vermont? Is it still gonna be sent to a local office after that? (I’m in Brooklyn, NY)

 

How long do you guys think it’ll take for them to schedule my interview? I’ve been waiting since 2017 and can’t wait for this whole process to be over.

Don't make the mistake not showing up to attend the interview. Go there and ask them to put your case on hold, if they deny then you can refile again. You should attend therapy to help you.

Oh wow, that’s a super quick interview after the approval. I filed on Aug 19’ and got my official approval in Nov this year. What’s your field office? 
Have you received any transfer notices on your 485 after VAWA approval?

I have received a deficiency notice from NBC right after posting that message here haha, so looks like my case has finally made it to NBC. It sure will, we are almost there! ❤️
