My vawa was approved in march 2020, filed i485 on dec 2018, on nov 29 2021 I received RFE for i693, got them done quick,sent to uscis quicker and the i693 arrived to USCIS Queens Office on December 9 2021,

 

This week will be 4 weeks since my I693 arrived to USCIS.

 
 

can you please let me know by when do you estimate uscis queens will approve my i485, and how long should I wait before I do a follow up? I heard that 2 months after uscis receives the rfe response is a good time to follow up on why they havent replied to my rfe documents

could I do a follow up callling uscis, would you recommend me to contact my congresman too, or what other method would your recommend me?

 

Please let me know

They  might take 2/3 months to set up your interview.

There is a difference between shared residence and bonafide marriage.It seems the person  proved bonafide marriage but couldn't t prove ''shared residence ", and they requested more evidence, because the evidences submitted didn't satisfy the service.

Did you divorce before VAWA approval? They want to make sure you had a qualifying relationship, it means that you did not divorce before VAWA approval.

Asking the educated people.

It seems people have been making false news about people with a prima facie can't get deported. Is this true? Or false.

If so why could a immigrant who even serve the military get deported but this prima facie person can't?

No!.VAWA confidentiality provisions prohibit disclosure to a third-party of any information related to your file.

Hi I opened my vawa case December 10 2020. My green card application was pending and me and my ex American wife was on the process for the divorce. Before my 2 year green card interview we got divorced. My lawyer was able to go to USCIS and asked them if you could hold my case because we were going to apply for vawa and USCIS told her that they will honor it. So far, I’ve got prima facie and my c09 work authorization card which is valid for 2 years. I just wanna get some feedback:(. Do you guys think, everything is going well so far? And how long would it take them to accept my case? And after approval since they told me to hold my green card application, will it still take another year to get an interview? Thank you guys!! I hope we will get our cards soon!!:(

If you need to work then you must have a  work permit.If you worked without EAD before filing VAWA the USCIS will forgive you, but don't break the Law now.

Do you happen to know how long I’ll have to wait for an I-360 approval so I can go ahead and file for the green card?.  Thank you.

just out of curiosity , did you receive a medical deficiency notice, by any chance? If yes, how long did it take from this medical notice to biometrics/interview notice? Thanks 

 

No, I did not receive that deficiency notice. In fact, aside from the 2nd biometrics that I have done there was no update on my 485 at all. My inquiry with the senator's office confirmed the transfer of it to my local office.

Are you saying you can not  divorce before USCIS make a decision on a VAWA case? please clarify

Because, I'm just guessing. 

If the family I-485 was not yet denied,  and it happens that you filled a new form I-485 along with new I-765 and I-131 and be asking the USCIS trough a letter to keep the other pending I-485 on HOLD. They May not do it because they are aware that you have filled a new I-485 form. It is like you were asking them to keep two I-485s.

My advice is just to wait until you receive all your notices of action receipts. Then, you will go from there because everything will become new. 

I don't think they will immediately put you in a removal procedure, because before doing so, they will check to see whether you are have not filed another qualifying benefits through your Alien number.

Trust in God through Jesus-Christ his son and YOU WILL BE FINE .

 

I sent the vawa with new 485 before the denial of family based 485. My attorney said we can file a new concrrent filing and also send a letter to hold in abeyance to save my previous EAD application (which was yet not issued) so I don't have to wait another 8-10 months for the EAD.
