Good evening Fam! I attended my interview for my AOS this morning and a new card is produced after an hour. My timeline is this -

Sep '19 - I-360 and I-485 filed

Oct '19 - Biometrics

Jan '20 - Received EAD

Consistently received Prima Facie

Apr '21 - I-360 New Card is being produced

June '21 - I-360 Approved

Oct '21 - Another Biometrics for 485

Nov '21 - Reached to Senator's office as my 485 is out of processing times

Dec '21 - Received interview schedule

I hope this can help if anyone is waiting for their petitions.

Congratulations!!!

I filed 485/360 in Aug 19’, so your post is very encouraging, thank you for sharing 😊

just out of curiosity , did you receive a medical deficiency notice, by any chance? If yes, how long did it take from this medical notice to biometrics/interview notice? Thanks

Thank you, I appreciate all that you said.

I did file VAWA a week ago with 765, I-131 and 485.

The 485 that got denied was from my family petition.

Does this denial letter affect me in any way since I've already filed for vawa but I haven't received the receipt notice yet? thanks for your insights

Sorry for asking you this question.

Did you send the I-485 form before the denial of the family's one or after its denial?

Because, I'm just guessing.

If the family I-485 was not yet denied,  and it happens that you filled a new form I-485 along with new I-765 and I-131 and be asking the USCIS trough a letter to keep the other pending I-485 on HOLD. They May not do it because they are aware that you have filled a new I-485 form. It is like you were asking them to keep two I-485s.

My advice is just to wait until you receive all your notices of action receipts. Then, you will go from there because everything will become new.

I don't think they will immediately put you in a removal procedure, because before doing so, they will check to see whether you are have not filed another qualifying benefits through your Alien number.

Don't be afraid,

Trust in God through Jesus-Christ his son and YOU WILL BE FINE .

Wednesday means time for our approval-evoking* Semiweekly Semiofficial VAWA-Thread Joke:

*that is, if correlation = causation

===================================

WINNING THE LOTTERY

A woman came home, screeching her car into the driveway, and she ran into the house.  She slammed the door and shouted at the top of her lungs, "John, pack your bags!  I won the lottery!"

The husband said, "Oh, my gosh!  What should I pack, beach stuff or mountain stuff?"

"Doesn't matter," she said.  "Just get out!"

:P

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Guys Could you advise me if it's worth reaching to Ombudsman about my pending over 2 years I-360?

Rosa if i remember correctly, i think your applied in Nov 2019?

If yes then i would say do not do that right now. USCIS is taking 23 to 30 months. Even if you contact them most likely you will get the standard response form them that your case is within normal processing time.

I can understand your situation. I applied a month after you.

Is there anyway we can add to the statement after submitting the case?

I forgot to mention important events in the statement because I was writing it during a stressful time with the abuse so I forgot mentioning many crucial information and events. My statement was so long and painful I still can’t read it because It’s painful for me.  Many things also changed and got worse after submitting my file but I really wish I can add them.

You can add more things, just explain what you said here and mention what you didn't mention in the previous affidavit, don't submit a new affidavit mentioning things that you mentioned before.

If they denied because you couldn't prove bonafide marriage before then you have to prove bonafide marriage now, but if they denied stating you had a "sham marriage" then they will deny your case.

@sandranj

Could you please let us know how some cases are taking more than 22 months? as you mentioned, in your earlier post that it takes between 19-22 months.

I have cases filed in  2018 pending and  I had several  2020 cases cases approved. Depends on how fast each officer works.

Hi everyone,

My vawa was approved April 2021. After that it was a complete silence till i asked congress person to send an inquiry for i485. Within few weeks after that i got the biometrics appointment for i485 which i got done in December. So what’s next? How long more for approval of i485. Almost an year again of vawa approval

it depends on the workload of your local office.NYC for example  is taking at least 18 months  to adjudicate the AOS.

You don't need to worry. If statement submitted is not satisfactory enough, uscis will issue you rfe with hint on possible amendment required.

Your information is not correct.USCIS can deny  a VAWA case without issuing  a request of evidence.

Hello @sandranj mam I have a question for you, I didn’t renew my c09 card since I got approved vawa, I only Renew c31 card, do you think I should go ahead and renew it now or just wait for my interview. I’m so worried at this moment if that would be an issue for me not getting an interview or so.

I also wanted to find out if I should wait an do my divorce after interview or just go ahead now and do it now.

Thanks you.

If you need to work then  you MUST have a valid work permit. You can divorce, considering that your VAWA was approved.

I haven’t filled for I -485 yet. My lawyer had advised I wait for vawa to be approved. C31

When the person has a weak case most lawyers advise to wait the VAWA decision, but if your case is strong and your spouse is a U.S Citizen then you can file for adjustment of status now. If you need to work then you must have a  work permit. If you worked without EAD before filing VAWA the USCIS will forgive you, but don't break the Law now.

Does anybody know what happens after you call the EAD expedition number? They give you a fax number where you send your support documents?

You can't  fax over documents to  VAWA Unit.
