Your EAD is not based on VAWA, it is based on I-485

Thank you so much . I really really appreciate your help . But the situation is that i switched before i went to the interview based on my i130 but since my wife didn’t go they denied but thank God i apply vawa before the day of the interview and show the proofs to the officer .  so i was kind of confuse if i can still apply .

If your I-485 is still pending, then yes you can file for a renewal of your EAD using form I-765.

Yes, your I-485 was transferred over to the I-360 and remains pending. Your eligibility for a C09 EAD is based on pending I-485. So yes, you can renew it.

Thank Demise you put a big smile to my face , i was worried about when im going to be able to see work and travel to see my parents back home . So Monday Inchallah i will try to apply for renewing.  Again thank you

The majority of people seem to get back in on AP just fine. Some of the forum members traveled on AP as well. Few bad stories though. What I heard from an immigration attorney on YouTube was that AP is not a visa, there is no guarantee they will let you back in. It is up to the CBP officer's whim and fancy. The AP approval form itself will state that the approval does not guarantee re-entry. Go ahead and travel if benefits exceed potential risk. Please post your experience on this forum if you do travel. 

 

I request the rest of the community to please chime in and correct me if I am wrong. This is the essence of what I gathered from multiple sources. I have an approved AP and approved h1b for consular processing. But too scared to travel to Mexico city to get consular processing done and come back on h1b visa. If there is a chance that I might be denied re-entry, it will destroy my career and tank my income.

The purpose of AP is to enable you to travel for short term while your case is being adjudicated . The only issue I have heard people had was when they have unlawful presence before getting paroled or any kind of status . When you leave the US while accumulating unlawful presence . It might cause a problem at the re-entry . If you have never fell out of legal status . You have nothing to worry about .

You're welcome! My VAWA was approved on March this year and my interview is on Nov. 17. Wish me luck!!

Very good to know, thank you. Question - if there is no prior history of unlawful presence, then the "period of authorized stay" during pending VAWA petition doesn't count toward unlawful presence, right?  @Demise this is a question for you too. 

 

Every attorney I talk to has a different answer for the AP travel question. I would very much prefer to be back on valid h1b status.
