My fiance is the petitioner, I'm the one who will immigrate to the USA. Do only I need a police certificate?

 

We're trying to file form I-129F, Petition for Alien Fiancé(e). I think I have seen someone saying they were sent a REF because they didn't send the police certificates, and I thought I saw that on the RFE the USCIS asked for the police certificate of both the petitioner and the alien fiancee. But usually I see the word "applicant" which I suppose is the alien fiancee, meaning me. On the other hand I've read something about him having to prove he's not someone who will harm me and seclude me in a foreign country, and then there's this information which said that they will let me know about his police records, so maybe they will be the ones to check this... 

 

Do we both need to send police certificates with the form?

You need to read the guides for (K1 as u say fiancee)

at this time no criminal reports are sent in with the petition (as things can change )

the USC never has to give one as USCIS will check for him

the immigrant (u) will take one with any translations into English if needed to interview

 

this process is different if you are married as copy of report goes to NVC with original to interview

not sure where u are reading but the US does protect both the USC and the immigrant in this process

 

forget Facebook,    and other apps and read guides here and/or what USCIS site says

There's too much data and too many guides for visas that say different things. And websites where people write like this one. Eventually it turns to mush in my head. But even the USCIS info is confusing enough and I thought it may be possibly incomplete.

This guide seemed very well put together but at the same time was really confusing as at point 11 they mention with form I-129F to send criminal history. Could be that what they meant is if you are a criminal you have to provide it. Which we aren't. 

 

I dont use my facebook except to communicate with old mobile users.

Beneficiary's police certificate is NOT required for filing the I-129F petition.  It will only be required at the visa interview.

 

Petitioner's police records will be required for the I-129F only if the petitioner has ever been arrested or charged with any crime (excluding minor traffic violations).  If your US citizen fiance has never been arrested or charged, no need for any police records to file the petition.

Thanks. I have this open in another tab, as well as this https://www.uscis.gov/i-129f where it says "did you provide the following." Thats a relief, because translating wouldve prolly only been for this document necessary. As the rest have English by-translations on them.
