SSN after expired I-94?

Hi all, my husband is Canadian and came to the US on a K1 visa and we married and filed the AOS/EAD. I live in Florida and receive a homestead tax exemption on my house/property. I got notice that I need to re-file and include my husband on it, and it requires a SSN, which he does not have. The form states that he must be on it even if he is not on the mortgage. We tried applying for a SSN and got an appointment with the office, only to have them turn us away because his I-94 was expired. Is there any way around this? We also applied for a EAD expedite (which would also give the SSN) for substantial financial loss, and after more than 3 months they denied it. We tried to reapply for the expedite and they said we were not eligible. Any ideas?? :(

Did you marry on or before December 31, 2020? If so, continue reading the info below. If not, then the notice was issued incorrectly.

A notice from the IRS? If so, re-file by paper and include a completed W-7 application. The W-7 can either be certified by a CAA or at an IRS Taxpayer Assistance Center: https://www.irs.gov/individuals/how-do-i-apply-for-an-itin

@HRQX We married Feb 10, 2021. Why was the notice sent incorrectly? We got notice from the county in which we reside in, not the IRS. 
 

The notice was because I got married.

The notice is about property local tax exemption and has nothing to do with IRS. You have to abide by the local county/municipality tax code and if they are asking for his SSN, talk to them if there is a way around it till he gets it.

 

Regarding obtaining SSN, now that his i94 is expired, he can only apply for it once he gets his EAD or GC in already not applied through those forms.

Have you called the county or better yet gone down in person to discuss your issue? Try that and see what they can do for you. Discuss that he is not the homeowner. He is not a citizen or permanent resident. He is not eligible for a SSN for a few months, but you will provide it when he receives it. He was not your spouse on Jan 1… my county goes by Jan 1 for home owner of record, yours may not but worth an ask. What do they use for other foreigners who own property in Florida? I guess they’re allowed homestead.
 

Question: How does the county even know about him?
