Hi all,

 

I’m a little annoyed with a situation and not sure if I should say/do something to USCIS about it or turn a blind eye. 
My husband recently became a citizen, he has a ‘friend’ who married a citizen overseas. They moved to the states, had 2 kids, but seemed to be struggling financially. Not sure about that one. 
Fast forward a few years, he applied for his 10 year  and still waiting. The wife and kids went back to their original country in the spring (wife was born in the states but raised overseas that’s how she has US citizenship) and the husband is here working to save money. 
He asked us if he can temporarily change his address to ours until he finds a more permanent place to live. We said ok. 
 

Not sure if that was wise. He found a place, actually renting a room, he’s asking for the lease to be in his name and his wife, even though she’s not here!

But his address with the DMV is ours. 
I don’t think he’s planning on changing it, but it’s starting to make me uncomfortable,  Not only that, but I feel it’s taking advantage of the system!!!

 

We did everything by the book during the visa, green card and citizenship process. 
I don’t know if immigration do random visits anymore, if they do I plan on telling the truth. 
But I just don’t need to be in trouble, know what I mean?

 

What do you all think?

Hello,

 

What is the issue?  Do you believe the other family has separated/divorced?  For removing conditions, the applicant may live apart, as long as they are still in a relationship.  The burden of proof of relationship is on them and USCIS will review their case.

 

Being together is important for filing for citizenship under the 3 year rule, but not for removing conditions.

Thanks for your feedback. To the previous poster, he is actually not a real friend, works with my husband. 
Will see if we can have a conversation with the guy. Just all of it seems wrong but hey who am I to judge.

Point it out that Virginia requires change of address on DL

 

https://www.dmv.virginia.gov/moving/movinginva.html

 

You have thirty (30) days from the date of your move to notify DMV of your address change. You may purchase a new driver's license with your new address ...

I’m also trying to understand what is “wrong”. You said this all happened after a few years, it’s not like the wife moved back as soon as he had a green card or he moved out as soon as he had one? Sounds like they tried to make a go of it, it didn’t work out, she decided to move back as is her prerogative and he decided to stay, as is his. As long as the marriage was entered into in good faith he has no immigration issues if they subsequently separate or divorce. And in fact from what you’ve said it sounds to me like there is still the possibility they get back together as a family, whether she returns here (maybe that’s why the lease is also in her name?) or if he saves some money (as you said he is) here and then moves back with it that’s also ok.   As noted above unless there is misrepresentation for the purposes of naturalizing within 3 years there doesn’t seem to be anything actually wrong on the face of it? What do you actually think he is doing that is
