Is Certified copy of judgment of divorce acceptable

Hi, i am in a Cr1 for my wife. Was married before and the consular is asking for the original and copy of the divorce . I do not have have an original but the court in NYC gave me a certified copy of the divorce. Do you think a certified copy is acceptable if i don’t have an original? Anyone ever been the the same situation with a consular processing? If they refuse the certified copy of the divorce what options do we have if we can’t get an original?

A certified copy from the issuing source is as good as an original.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Immigration should keep the one u have for their files so i would order an extra

 

Vital Records has the Certificate of Dissolution of Marriage for all divorces or civil annulments for New York State since 1963.

 

  • Divorce Certificate. This document contains basic information about the spouses, and the date and place the marriage ended. It is filed with the New York State Department of Health for divorces granted on or after January 1, 1963.

its what NYS gives out 

 

print out the page that says that and send that in with your certified papers

The Officer wants the original certified copy instead of a scan or photocopy of it.  The "Original" is property of the court.

 

This request is probably because they want to see both sides of the document and/or the original stamp etc.

Facts are cheap...knowing how to use them is precious...

NYC is never going to part with the original document.  I’ve never heard of a consulate rejecting a certified copy of a divorce decree but 50 percent of world has an IQ under 100 and it seems some of them work at consulates.
