IR1 Ap in BD more then 10 months......... Still no reply from embassy

Hello everyone,
I have appeared interview in January 19th in this year and consular kept my passport with civil documents and our wedding pictures and told me they will contact me very soon but it’s more then 10 month still in Administration Process , case status date updated month then 10 times but still in same position. We married in 2018, visa category is IR 1, my wife contacted embassy with congress and senator and herself as well and I also send emails and calls but same answer every time . Is there anyone in this situations or what is the possible suggestions at this stage? I didn’t receive any 221 g letter.

What is the answer they give every time?  

Administrative Process cannot be waived or expedited.  The ONLY thing you can do is to sue the DOS via a Writ Of Mandamus.  That won't be cheap. That could force them to render a decision which could easily be a denial.  Your choice....and your consequences.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As I suspected.  You have no choice but to wait it out or sue the Department of State with the help of a good attorney.  Good luck. I hope the status changes to issued soon.

I hope so it issue very soon. your advise is just perfect few lawyers said the same. i don't want to Sue DOS as its time consuming and way to expensive to hair a lawyer for this, But can you assume how much longer it gonna take?

Hi Dhaka,

 

My husband’s case is in El Salvador, but he has waited 7 months and still no answer. I am not sure if it might also be related to the whole pandemic since a lot of US Embassies if not all closed for many months. I hope your case resolves quickly and you’re able to get your visa. Did the immigration officer told you you were approved?

No, officer told me that my case is in Ap, What about your case , did officer approved your husband visa ? did officer asked any further Documents

Your case will be in AP (CEAC site may say Refused) till the embassy does all the security checks that need  to be done

since your country has poor record keeping ,  this takes time 

when the embassy has completed the task and if the CO is going to approve and issue the visa,  you will get a notice to redo the medical exam

not the criminal report as the above security checks have done that 

 

it is possible (and i would think USC should expect this)   the USC may have to file a new I 864 and provide lastest IRS transcripts as u say your interview was in January and  2019 would have been needed

and now 2020 are required .   if the process goes beyond April 15th of 2022,   2021 IRS transcripts will be asked for

Even if an officer gives a verbal approval, visas are never approved until after all administrative processing and checks have been completed.  There have been cases here where a denial was issued after an officer said "approved".  I have haven't seen it many times, but it is possible.

My husband is still undergoing AP. They haven’t asked for anything else.

Just updated yesterday still refused, its been few times that case has been updated but still in same situation. now it close to a year as i appeared in this year January, its very unusual that IR1 case this long in Ap, Has any one experienced our situation like this ?
