Wife Arrived to US on CR-1 without Issue, but No Passport Stamp

Hi all -

 

My wife arrived in the US several weeks ago on CR-1 without issue, but didn’t receive any sort of stamp in her passport.  She entered through Global Entry if that matters.

 

From what I can tell, she should have received a stamp in order to “endorse” the CR-1 - is that ever not the case, where it may be done all electronically?  

 

If she does need a physical stamp in her passport, what is the next step?

they should have stamped her passport with I 551 

that allows her to work  ,   get driving license,  and so many other things while she waits for the actual green card

 

make an info pass to get the stamp

Here is what i found.  Global Entry is for USC, LPR, and citizens of few other counties that has Visa. 

 

 Global Entry members who are not U.S. citizens or U.S. lawful permanent residents must maintain updated visa information with CBP.  If a Global Entry member obtains a new visa, or obtains a new petition for a work visa, the member must notify CBP in-person at a Global Entry enrollment center.  A member must visit an enrollment center to have CBP add visa and/or update visa information. If the visa information is incomplete or not properly updated with CBP, the Global Entry kiosk may incorrectly calculate the member’s Class of admission and admission date. A member must visit an enrollment center in-person to add or update visa information.

Yes, i think it is best to get in touch with immigration as the GE used probably have the old visa information?

Did she update her immigrant visa status on her global entry before travelling? If using global entry, i assume she scanned the passport biopage only at the kiosk and it allowed her entry based on whatever info it had internally/previously.  The visa was never registered at POE. That would mean very likely she wasn't admitted as an immigrant.

 

If that's the case, she would need to leave US and reenter an immigrant.

Is the next best step to call USCIS and ask them for guidance then (i.e., is that “calling immigration”)?  I wonder if this is something that can be taken care of by CBP at the airport or if she needs to actually fly out of the country and back in to “re-enter.”  I guess they’ll have the answer.

This might be more of a CBP case than USCIS.  Here is the website https://www.cbp.gov/,  I will try to look for info as well.  Where is your wife's Point of Entry?

I don't think uscis can help as it's now  on CBP's hand. Other's may chime in, but my take is she to reenter through CBP using the immigrant visa to get the GC. May be drive to nearest border, sneak out to canada or mexico and reenter?

Sorry, I cannot locate definite answer.. I suggest calling CBP https://www.cbp.gov/contact.  They can tell you better if she can go to POE office in your state or if she have to go out of US and go back in.

She does need that stamp. It doesn't look like she was properly admitted as a LPR.

Seconding.  This is exactly what to do.  There is such a procedure because CBP makes mistakes.  They are human.  In this case, it is the visa holder's mistake, but can still be corrected.

To be clear, she did NOT enter using her CR1 visa.  It was in her passport, but she entered using the wrong line.  Had she updated her status properly, she would have been sent through the regular entry point.

Exactly, mistake was on OP's wife, not CBP. 

 

This is explained during Global Entry/Nexus interview.

Go to a CBP deferred inspection site, and have them fix it. Just call in first and see if she needs an appointment: https://www.cbp.gov/contact/ports/deferred-inspection-sites

 

They will fix her admission record and endorse her immigrant visa.

Contradictions without citations only make you look dumb.

Thank you all so much for the help.  We are near a deferred inspection site, which was also my wife’s POE - we are going to call first thing Monday.

 

I’ll admit I’m a bit stressed about this as I thought we were finished with the process for the most part, but hoping it’s an easy resolution.
