Hey guys,

 

Short rollercoaster of a story but here goes. I'm filling out the 129f to bring my girlfriend over from Mexico to marry.

 

Roughly 5 years ago I was living with my male friend who I've known since high school. My friend gets a DUI and needs to complete court ordered dui program. During his course (I can't make this up) his DUI instructor gets a DUI and is fired from her job. The instructor needs a place to stay so my roommate let's her stay with us.

 

Roughly two weeks later I get into a verbal altercation with driving instructors boyfriend in our apartment and throw a beer can against the wall.

 

Police were called and the DUI instructor lies and says I was trying to fight HER. She said I threw a beer can AT HER which gets me an assault charge. Police never asked my side or anything, just arrested me and I spent the weekend in jail. That Monday in court DUI Debby was awarded a restraining order, and because she had been living there for 2 weeks it was considered a domestic dispute and I had to move out. She never showed up in court again after that (shocker) and the charges were dropped. 

 

Looking over my 129F I guess I have to answer yes to both of these: 

 

Have you EVER been subject to a temporary or permanent protection or restraining order (either civil or criminal)?

And 

Have you EVER been arrested or convicted of any of the following crimes: Domestic violence, sexual assault, child abuse, child neglect, dating violence, elder abuse, stalking or an attempt to commit any of these crimes?

 

Looking for advice on how to best handle this? Should I explain this in the additional details space? How to I go about getting certified forms? I'm currently across the country from where this incident took place. Do I need to go to the related police department and courthouse? Can this be done over the phone? I'm probably overthinking but this is just the first time that part of my life has come up again and I don't want to screw up my application.

It happened, the important thing is showing it was dropped.

 

CR1 I believe avoids these questions.

Yes, you have to answer YES for domestic violence. Yes, you provide the court records of the incident and that charges were dropped. Don't know how to get the paperwork you need, if you don't have the records still, so can't help with that part. Yes, you can provide your story/explanation on your petition.
