Hi VJ-ers

 

Today I went in for the I-1551 stamp. We are planning to travel to the EU in December.

 

Somehow it escaped my attention that my kids passport expires in February 2022.

She got the stamp, but the agent said that she will need a new one in February. That's when I realized the expiration date is less then 6 months when we return and I understand the passport has to have atleast 6 months left.

 

When we are in Europe she can get a new passport. But it will not have the I-1551 stamp. They ussualy return the old passport with a couple holes in it.. But I'm not sure if that's sufficient enough? 

 

Anyone experience with a situation like this?

It’s an interesting question.

US visas in expired passports ARE still valid, so stands to reason that I-551 stamps would be too.

 

My own most recent (lol) stamp actually is for a full year, and my passport expires four months earlier and nothing similar was said to me, so I’m curious. 
I’m gonna have to clarify it before I do anything - I can either do it by mail and get a new stamp in the new one, or travel and renew in person and carry both to return, but only if the stamp is still valid in an expired passport. I’m not risking anything without being certain. 

 

Can the passport be renewed by mail or at an embassy?  Is that something your country can do? 
What about for a ‘lost’ passport? Can that be replaced remotely or at an embassy too? 

 

The other option for you would be having the stamp on an I-94, which is an option (and often used for those without any or any valid passport). You would need to get some passport photos for this, but other than that it is a simple procedure that they (should) be well versed in issuing. 


 

One thing I do know though, is that you cannot get an I-551 stamp outside of the US. Boarding foils are expensive and a huge hassle if that were to be required so like me, get it clarified before travelling anywhere.

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

My husband and daughter went for the I-551 stamp last month. Her passport expires in November. Her passport was not stamped. A card was stamped and inserted into her passport that is removal. The agent stated this way when the passport is sent to the embassy for renewal, my daughter would still have her valid stamp for the new passport.

Hi @mindthegap, when I asked if she could travel he said: yes, she can.

But when I got home my husband was like: uh,it has to have atleast  6 months left for her to be able to travel back into the country.

 

We can go to the consulate in Miami and get a new passport, that takes approximately 2 to 3 weeks. Atleast that was the case in 2019, everything has changed since last year. We then have to get a new appointment for a new I-1551 stamp ( IF we CAN'T use the stamp in the expiring passport)

If we CAN use the stamp in the old passport I rather wait until we are in Europe. That ussualy takes a week ( or to apply and get the passport.

 

Ugh, this is getting so complicated, on top of all the constantly changing regulations for travel and covid.

Our situation is totally different and I can't seem to find any information about that. I'm sure others have been in the same boat before.

The trip is in Dec 2021 so both the passport and the I-551 stamp would still be valid then.

Your child will be all good for the December trip since both the passport and the I-551 stamp will be valid.

Apply for it in Miami after you return from the trip.
