I need to extend my son’s K-2 visa.

I was approved with a K-1 visa about 5 months ago and my son has a K-2 visa that will expire in a month.  Before I left for the US, someone from the US Embassy called me and told me that I can contact the US Embassy to extend my son’s K-2 visa.

I arrived at the US in June and now I need to extend my son’s K-2 visa.  But I don’t know how.  Does anyone know the process to extend a K-2 visa?

I tried to login to my account at https://cgifederal.secure.force.com and changed passport and other info to my son’s info and then to schedule a K-2 interview.  But my account was locked briefly so I don’t think this is correct.

Could someone help?  Am I supposed to create a new account with my son’s email? And then to request a K-2 interview?  Do I even need a K-2 interview (to extend K-2)?

Also contact/call the embassy and tell them the K-2 is now a follow-to-join case. How old is your son?

Visas cannot be extended.  They can, at the discretion of the consulate, be re-issued.  As @HRQX stated, a new medical will be required.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Kiev? My ex and I had a similar situation in 2010. The embassy in Kiev handled it painlessly. HRQX has given you the proper answer. Also, your son's age is important.

My son is 15 years old.

 

Yes, I will schedule a medical exam shortly.   But I am trying to schedule interview first (due to rising COVID cases there).  I am little bit consurn about time.

 

But I am asking what is the process to extend (or revise) the K-2 visa?  Do I now create a new account under his name, to file to get K-2 visa (but he already has) and then schedule a interview?

You have to contact the consulate to see if they will even allow an extension. This is not something they tend to do. You need to make sure the reason for the extension is a very good reason if you even want them to consider it. I would be trying to figure out how to get him to the US (you don't list why he can't come) before the visa expires.

You have already been advised to contact the embassy. Even if you could secure an interview through ceac, they won't just issue another K2 visa.

 

So the very first step is to contact the embassy and get their approval for the next step. Your best bet is to say you have decided for follow to join option for your kid even though he was initially issued the visa and ask for the interview for follow to join. Hope they accept that and tell you to go through the process.

 

You still haven't mentioned the reason why you left hour child behind but it seems voluntary. Zero chances of getting extension or reissuing K2 visa just because your child didn't come with you . Only if they approve your follow to join request your child could be issued another k2 visa.

It's best to get your son to the US before his K-2 visa expires.

 

There is no formal path to re-issue a K-2 visa.  It's at the discretion of the issuing US Embassy/Consulate.  With limited resources and COVID, there are only so many people who can be processed.  Your son already has a visa, so he is not a priority.   Other people who don't have visas will have priority over your son.  

If your son does not come to the US before his K-2 expires, your USC spouse will have to file an I-130 and it will take 1-2 years for your son to immigrate to the US.

A.  You can't schedule a medical exam without an interview date.


B.  No reason to interview a person who already has a visa.  

 

C.  There is no formal process to reissue a visa.  No such thing as an extension.   Reissuing a visa is at the discretion of the US Embassy/Consulate and there better be a good reason.

I did not bring my son with me cos we need to find house near school. We live in rented one room flat meantime.  So we decide to give my son time to finish one year school in Ukraine.

 

Before I come to US - I alredy contact embassy in Ukraine - cos I know my son have right to go to US withing one year after I cross the border. Embassy say - i just need to do medical exam second time for him and organise interview. ( but they skip details how to do it , wich accout etc. ) 

 

I can call embassy from US and ask this question.. it will be my second step.

 

But meantime I am trying to do it online, I believe it is possible, I already send letter to support about process - where child  go to interview without K1 petitioner. I need details - so better they send me some instruction.

So the question is not whether this is right or wrong, doable or not.  I am simply asking how now.  I know this can be done.  Just want to know how.

No one said this was wrong.  No one said this is not doable.

 

We are trying to help you.  We don't have a problem.  You do.  

 

First, the VJ Guides is not official government publications.  It's us writing them.  There are mistakes in there.  An K-2 can only be issued one year after a K-1.  The K-2 can have a validity date pass a year and it can still be used.  So, don't quote the VJ Guides as official and correct.  Sometimes, answers are not complete without context.

 

Second, there are easy paths and there are hard paths.  The easy path is for your son to use the visa he has.  The hard path is to get a reissue.

The choice is yours.  This affects only you and your family.  

Once again, no one said you can't do this or that it's wrong.  For those of us that have experience in immigration, we have pointed out to you that it is better for your son to use the visa he has than to try for a reissue since that path is not common and there is no written procedure for it as it is within the discretion of the US Embassy to reissue or not.  You have been advised to contact the US Embassy since only they can tell you what they want.  If they don't reissue and you have an expired visa, what will you do?
