They cannot give you legal representation but to break it down, we were told that we needed to pay the biometric fees for both children living in the Dominican.  We will never have to pay for the biometric fee to remove conditions on them again but we will have to pay for the application fee for any type of application that we fill out for them to come here to live with us.  Shocking but true. 

They are contractors and not know much about immigration. If they are not applying with you then you don’t need to pay anything. Inaccurate advice.

Timeline

Please talk to an immigration attorney. If you pay for their biometric fee, they will be expected to show up at their biometric appointment, which they won’t. Their non- existent application will get denied, and it can bring future issues if they do decide to apply for adjustment of status later on. 
I repeat: these are your husband’s kids. For those two, he’d provide their names on the I-751, but mark “no” for 4 and 5. The baby is a different story, still no bio fee.

Thank you so much. I will do that, I actually agree with your statement and fear that it was wrong as well. I will talk to an immigration lawyer before proceeding with anything

Just listened to this on youtube and people have been rejected multiple times because of this:

He’s talking about biometrics for people that are applying for an immigration benefit. Your step kids are not ! So I’m sure if you do mark the form the way I showed you, you’re telling USCIS “I won’t pay for these children biometrics simply because they are not applying for an immigration benefit”

By the way, Hacking is the Guru of immigration and he does have free consultation. They schedule about two weeks in advance (at least during COVID), so if I were you I’d be calling him today, to make sure you send those papers in time.

I do agree that the whole thing with children/ stepchildren is confusing with USCIS. I have been there with my AOS. I am the beneficiary, husband is my sponsor. I myself don’t have kids, but hubby has one from a previous relationship. So when I filled out my I-485, I put “no” to the question if I have children, because I thought they meant bio kids. Our interview got waived, approved and everything but the other day I was thinking about it. I called Hacking and his colleagues told me that for USCIS, stepchildren and bio children are all the same. So now, when I do my ROC, I have to put my stepson, even though he’s not applying with me. I was also looking at the N400 and this is the only form that mentions “stepchildren”. So it is VERY misleading!
