I 130 spouse visa

I'm currently on question number 10 of form I-130 "Has anyone else ever filed a petition for the beneficiary?" The answers are "Yes, No, and Unknown."
I am a US citizen and filing for my wife. Before we met she was previously married, her x husband filed I130 for her, however their relationship didn't work out and my wife decided not to continue with the process. It's been almost 2 years since she got notice to provide necessary documents to continue the process. She also have asked her X to withdraw the petition but unfortunately he is not cooperating.  My question is should I answer 'Yes' and  Will this be any problem with my petition? Thanks!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Possibly be prepared for her to get some extra questions/scrutiny considering the relative speed with which she’s moved from one spousal petition to the next.

 

 

Btw if he is her ex there is no basis for a  petition anyway, what do you mean he is not “cooperating” in withdrawing it?

YES answer YES. Otherwise, you could have misrepresentation problem on your hand.

Means he refuses to withdraw and I've heard only petitioner has right to withdraw a petition.

The petition died when they got divorced. There was no longer any basis for the petition. I am not sure you have the whole story, or maybe your wife doesn’t.

Where is the beneficiary from? It'll probably more of a problem if she's from a high fraud country. 

Is she in the States or will she go through an embassy? If you're both in the States and she is out of status, it'll probably be a bigger issue.

Get yourself an immigration Lawyer, you do have a complicated case.
