hello

 

i just need a quick guidance on what my wife and i should be focusing on doing soon. 

 

So my wife and i are thinking of visiting philippines soon and her passport is expiring in 9 months. But ever since pandemic started and her being pregnant and giving birth to our son. 

We havent really had the chance to take care of them. 

So heres the situation

 

my wife's name on her passport is still her maiden name. But on her greencard/social and state id she has my last name on all of them already. So i was just wondering, what requirements does she need to be able to renew her passport with after married name? 

And btw do i need to legally apply in court for her to change her maiden name to after marriage name? Or i dont have to? Since her social/greencard and state id has been updated already. Sorry i dont really know much about these thing and cant really afford any immigration attorney right now. Hopefully you guys will be able to help me somehow.

 

And does she have to report to the philippines consulate that she had got married already?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Others will correct me if I am wrong. Your marriage is the legal process in which her name was legally changed so nothing to worry about there. I am not sure if she will need to do a ROM (Report of Marriage) before getting the passport in her married name, I think she does. I don't think that they will just accept your marriage certificate.

@RO_AH is correct: you will need to do the Report of Marriage with the PH consulate that covers your state. With this document, your wife will be able to apply for a Philippine passport in her married name.  You don't need to go through a court for her legal name change.

 

Without the Report of Marriage, the consulate may still renew your wife's passport, but only in her maiden name.

 

If your state is covered by the PH embassy in Washington DC, here are the requirements: https://philippineembassy-usa.org/e-passport-renewal/

 

If your state is NOT covered by the DC embassy, search for the exact requirements on the consulate website.

Im from houston tx, i think there is consulate here.

What would be the requirements so we can do the ROM? and fyi we've been married for almost 2 years now. I dont know if that matters or anything.

Just a quick question

 

does anybody know how long does it usually take for them to process the report of marriage?

 

and if my wife were to go on vacation with her still password (maiden name) and come back to the us with her greencard (married name) will she have any trouble at the immigration since both of the document had different name on it?

The Report of Marriage only used to take a few weeks but it seems to be taking months now according to latest reports.

 

Bring your marriage certificate and book your wife's flight in the name that matches her passport. You should be fine.
