Hi guys

 

Does anyone know the answer to this....?

If a couple months away from the 2nd anniversary, is it better to wait and enter the US for the IR (let's say 2 yrs and 1 day) or should u get it over and done with and get the CR now?????

Hope it makes sense?

As long the visa is valid, enter the US after 2nd year anniversary. You'll pat yourself later on.

That is what I was thinking.... if I wait a couple months I'll avoid the whole removal of conditions step...

 

At the moment at the embassy I'm a CR but after the 2nd anniversary would that change automatically? Or do I need to inform the officer on entrance?

Yes, regardless of what the visa says, if you enter the US after the 2 year wedding anniversary, the CBP officer should note IR1 on the stamp.  You may need to remind them though, so pay attention when going through arrival, and once the physical GC arrives.

What determines if you are IR1/CR1 is the date you enter the US. There are many reports of the CBP officer not really caring, don't argue and be on your way. It's down to the USCIS who issue the Green Card to spot that you entered after the two year anniversary and issue you the 10 year Green Card not the CBP. 

 

If you get a 2 year Green Card entering after your two year anniversary you can submit a I-90 form for free to get it re-issued with the correct validity.

I also would like to ask the pros of waiting after the 2 yr anniversary to enter as IR instead of CR, in my case it’s another 3 months 😩 , I haven’t seen my husband since Feb :( 

 

Really torn between leaving asap after visa approval or wait to enter as IR. 
 

Is filing I-751 to remove conditions straight forward or lengthy and painstaking?

Waiting few months and enter after 2 year anniversary:

 

Cons:

1. Need to keep sharing/doing love via video call as opposed to in person for additional few months.

 

Pros:

1. No need to worry about gathering tons of evidences to show continual marital relationship. Sometimes it could be much more than what you compile to get the immigrant visa.

2. $600 or more savings

3. No need to worry about delayed processing times for 751

4. No need to worry about international travel due to delayed extension letter or nit getting ADIT stamp in time after extension letter expiry.

5. No need to hassle with employers who has poor understanding of extension letter or ADIT stamp

6. No need to worry about State ID or DL in some states who limit the expiry to the GC.

7. No need to worry about what will happen to the spouse if divorce processing happens on good terms.

8. No need to worry about delayed citizenship approval due to pending i751.

9. No need to read anything 1-8 above but yeah you already did.

 


If you don't wait extra few months and immigrate as CR1, then reverse the pros and cons.

I think $680 fee and complicating citizenship application (because it won’t get approved before you’re eligible for citizenship) would do it for me.

 Mine was definitely my largest packet submitted during immigration. Lots to gather and compile with evidence dates covering two years.

In my case, i had the US embassy Nepal postpone my wife's interview (initially scheduled 1.5 months before our 2nd anniversary) any day after our 2nd year anniversary. There was no need to postpone the interview but since my wife said "I have the visa on my hand, i am flying the next day", I had no choice but to get help from the embassy to not deal with i751. Best decision ever.

Best not to delay the interview; interview slots are difficult to get in most embassies, can't tell where yours is. 

 

The Visa is valid for 6 months from the date of your medical exam.
