I-130 Petition Approved September 23, 2021.  Initial Interview conducted April 21, 2021.  Second Interview conducted May 5, 2021.

  • In Notice of Intent to Revoke (NOIR) dated August 6, 2021, I was informed of USCIS/TSC’s intent to revoke the approval of the petition.  (Fully aware of the reason why. Legally prepared to address.)
  • With the assistance of new counsel, prepared a 454-page response that included a 7-page brief, a Court Order, numerous affidavits, medical records and hundreds of pages of clear and substantial supplementary evidence.
  • The requested information and all supporting documents were sent via USPS Priority Mail (2-Day) to the address listed in the NOIR: USCIS/TSC  ATT: RFE/NOID 6046 N Belt Line Rd Ste 172 Irving, TX 75038-0015.
  • Per the USPS Tracking Results which have been provided as additional evidence, the package was delivered and picked up by "an individual" at the postal facility on August 23, 2021.  
  • On September 30, 2021, while checking the USCIS website, I learned that a decision had been made on my case and with great disappointment, downloaded the Revocation Notice dated September 30, 2021.
  • The Revocation Notice alleged that I have not responded to the intended revocation or provided any additional evidence in support of the petition within the time provided.  The claim is categorically false. (Response was received by USCIS on August 23, 2021 per tracking available.)

>> Timely response to notice was responded.  USCIS does not indicate receipt despite tracking that shows delivered.  (I have re-sent with signature required.)  Has anyone had a similar experience?  Any recommendations?
