GC expires on 12/16/202, can I travel before it expires while waiting for the extension letter?

Hi all, 

 

My green card  expires in December and my company just purchased a ticket for me    to attend an event in Mexico from 10/07 to 10/13. I consulted with a lawyer and he advised not to travel without the extension letter because he said they won’t let me back in because my GC is so closed to be expired. Is this true? 
 

have any you travel with your green card closed to be expired and no extension letter? 
 

I filed for ROC last week and now am waiting for the letter. 
 

Any advice or help would be appreciated.

This is false. Go travel.  The reason you have a valid  gc is to let you back into the USA. 
 

Now if your gc expires while you are out you will have lots of problems.  Since your travel has you returning more than 2 months before the card expires, you are fine.  If you were returning 2 weeks or less before expiration I would advise you to enter the USA via land and not fly due to onerous Covid protocols. 

 

We will be testing this ourselves soon and will report our experience

Fire the attorney immediately.  That is 100% incorrect.  You can safely re-enter the US (without an extension letter)  up until the date the card expires.  That attorney should be reported to the state bar.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It is hard to prove that he actually advised her not to travel. There is no solid ground for a complain. Certain fact : don't trust anybody, investigate on your own as much as possible and use VJ!
