October 2021 - AOS Filers

She told me that my partner (in her doing research on our case) shouldn’t be able to return to the country until his I-131 is approved. But I don’t think that has been reopened.

Thanks for the tip - I am going to try sending our documents via registered mail, too, if we don't see any action within the next few weeks.

Any update?

Nothing since we uploaded our documents on April 18th. Our congressperson said they would put it on their calendar to make an inquiry for us every 30 days until approval. 30 days is coming up this week, so hopefully the inquiry will push things along. 

I-129F Sent: 12/29/17

I-129F NOA 1: 1/4/18

I-129F NOA 2: 7/9/18

NVC Received: 7/18/18

Consulate Received: 8/9/18

Packet 3 Received: 8/13/18

Interview Date: 9/20/18

Interview Result: Administrative Processing

 

*Visitor's visa interview: December 2016, called back by embassy for second interview on same visa application in January 2019 - visitor's visa finally issued May 2019.

 

*Fiance visa placed in administrative processing September 2018. 

 

*Beneficiary's Country: Norway via Iran.

The wait is brutal especially since you already gave them what they requested it makes no sense the lack of communication. 
 

Here’s hoping you’re not waiting too much longer now!

We just got an RFE on the 25th for the I-131. They want proof that my partner did not leave the US and abandoned his petition. But he had only left because they sent me a letter denying the case and saying the decision was final and he didn’t want to be here illegally. It was only a month after he left that the case was reopened on USCIS error. 
 

so I really do not know what to do at this point. My daughters miss their dad and I miss my partner so much. Going to try to call tomorrow to request an in person appointment to explain the situation or something. I don’t know, wish us luck.

Get an attorney.  This is way outside the scope of DIY.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

After your previous update about USCIS' reopening the case, with your husband back in Oz,  I was suspicious that this was not going to go well 🙁I have no advice to offer and only suggest that you do exactly what @Crazy Cat suggests.

 

USCIS has done you such a disservice, trying to do this without an experienced immigration lawyer may hinder your case even more, if that can even be possible, considering what has already happened to you and your family.
