Issues obtaining SSN after K1 visa

Our case was exactly like yours: waited over two weeks, applied after getting married, no name change, didn't request for an SSN on the AOS forms, info was not on the SAVE system; but we got the card a few weeks later.

I guess it's a matter of luck -and maybe the fact that we went through this a few years ago-.

It took them almost 6 weeks to get me my SSN after applying for it almost immediately after crossing on my K1. I knew SAVE updated immediately with my crossing cus I checked. But what did make them send me my SSN was because I literally called them every 3 days. 

 

Yes, every 3 days during the 6 weeks of waiting. Getting bounced around from agent to agent not knowing what the h*ll I was talking about. Nor knowing the K1s are allowed SSNs! I had to quote their own regulations many times! I believe whoever was the supervisor of that location kept hearing my name so much they probably figured it out to get it to me. 

Sometimes it might just take a little persistence to get things moving ;)

How would changing my I-94 record affect my AoS application? As I recall, one of those AoS forms requires to you give your name exactly as stated on I-94.

I would go to another office or try to speak to the head person at your office. 

My husband applied for his SS card a day after arrival on K1. We faxed over all necessary documents and were told it would take about 2 weeks for DHS to verify. After a month, they called and asked to resend everything again and once DHS can verify they will schedule an appointment. Another month went by and no update. A couple of days we received a letter from our SSA office saying that they can’t issue a SS card because DHS is unable to verify the immigrant documents we submitted. I just checked his I-94 and his middle name is not on it. It’s on every other document (passport, visa, etc.) What can we do? His I-94 expires on 10/26/21.

Always apply for a SSN before getting married. And there's no 2 week wait time, many of us applied for our SSNs within hours or days after entering the US. Despite my i-94 issue I still managed to apply for my SSN 4 days after arrival. 

How long did it take for CBP to correct the error on your i-94? My husband has a pending AOS will it affect it in any way? We applied a day after his arrival and it took them almost two months to send the denial notice. I’ve tried calling every day but, it’s so hard to get an agent on the phone, it’ll just say that they have high call volumes and to try again later.

It was fixed in a matter of hours, so very quickly. This was obviously back in 2016, maybe things are different now.

Thank you for the fast response! I just called JFK which was his POE and they’re closed today. I will try again Monday and hopefully they fix it ASAP so I can resend everything to the SSA as his I-94 will expire soon.

Can save really be this slow or is there something more serious amiss here? I still have time left on my I-94 so if possible I would really like to get this rectified, mostly so I don't lose my ability to drive (in my state foreign drivers cannot drive on foreign DL after 60 days of establishing residency). I know there is nothing that can be done to "bump" the SAVE system along, but assuming they come back again not being able to verify my status, is there anything else I can do?

 

Unfortunately no there is nothing you can do if they come back again and are not able to verify your status. Keep an eye on the "pending status" and hopefully it will soon change to "case sent back to agency" (SAVE Case Check : Login Agreement (uscis.gov)) and then call your local office to issue your SSN. I am adjusting from K1 as well and monitored my verification status on this Save website. Had my appointment on July 28, it was "case under review" on July 28. Then "case sent back to agency" on Aug 9. I kept waiting to get my SSN and when I didn't hear from them I called my local office on Aug 18. They issued my SSN on the same day and I received the card in post on Aug 24.

That’s a Detroit airport (DTW)  email. Was that your POE?

This thread has some great information.

We unfortunately timed out on the 90 days due to the SS being so slow.

We tried getting this figured out as soon as we crosses and they told us to wait. Wrong information.

Then we were told that we needed to be married. Also wrong.

Next that we needed a marriage certificate. This is also not true. and unfortunately the marriage certificate took about one month.

We also tried going to other offices. We called. The other office was much friendlier and wanted to help us but you are restricted to going to the local office. They ask for your zip code. At least that is what we were told. 

We also checked on Saves and they checked twice and sent the info back to the agency.

The local office claims that DHS had not verified status which is also wrong.

In the meantime we timed out. We called the local SS office and they told us to wait. Because they lied and claimed DHS could not confirm status or whatever. We can see on SAVES that they checked twice and they replied back to SS.

we will check the mail to see if anything happened, otherwise our only recourse is wait for the EAD

I don't think you should have issues with AOS. At most, you'd receive an RFE.

I think the form that requires so is the Advance Parole one? If so, then your card could come without your middle name on it -could not as it is a combo card, so the name could be as stated on the EAD form-.

LAX, and they fixed it just fine for me.
