I would like to get some help with this issue.

My niece husband received the packet from embassy in pakistan for his K3 visa. She is a student and works part time during summer so will need a co sponsor for I-134.

Her father owns 2 houses worth $60000 plus each and has owned them for last 3 to 4 years and has filed taxes for about $ 18000 income last year with 3 dependents on his taxes. Can he submitt I-134 as a cosponsor? Any feed back is appreciated. Thanks

If the equity not just "value" of the homes equals a total of $120,000 then it could be converted to the cash equivalent of $24,000 in qualifying income, totalling $42,000. If that meets the 125% of poverty level for his household size including the niece's husband, where he lives, then he would qualify as a co-sponsor.

The father's equity in the houses aside, there is no firm guideline for how to treat assets in making the public charge determination for a K visa. You don't provide much information, but what you do provide makes the father seem like a marginal candidate for sponsor at best.

Anybody can be a cosponsor. Looks like he will need one I-134 from the wife and one from the father in law (or you?). Basically the combined income from both the I-134s must be above the poverty level for the houshold for this year. It should be straight forward to figure the equity on the houses, as there is place for the appraised value and the amount of outstanding mortgage on the i-134 form. You will need to send the Tax statment to prove the house values, letter from mortgage company showing how much is still owed against the houses. Also you will need proof of the sponsors US citizenship. Also past three years tax returns or IRS transcripts for the sponsor and co sponsor. Go to USCIS website and look at form I-864P, it is latest poverty guideline (under 125% column), unless you live in alaska or hawaii, it is $25812 for household size of 4 and $30162 for 5. This is just my opinion, I am not a lawyer. Hope this helps.

No, "anybody" cannot be a "cosponsor". In addition to the financial considerations, there are other requirements for sponsoring.

The co-sponsor fills out the form. If they don't qualify on income alone, then they'll need to truthfully state their assets and provide documents to support all claims. Two houses worth a total of $120,000 would be one line item. Any mortgage against either or both properties would reduce the "equity" by the balance of the mortgage. It is the "equity" that can be considered. Generally a spouse's cash or equity is considered at a 3 to 1 ratio, so $30,000 cash could replace $10,000 in income. When the sponsor is not a spouse the guideline is 5 to 1. So if the income is short by $10,000 the father in-law needs $50,000 in equity to fill the gap.

There is no guarantee in any of this. If I were you, I wouldn't count on any Consular officer beleiving the co-sponsor would liquidate his homes to bail you out of financial jam. I see this as a marginal possibility for sponsorship, even if the equity is the full $120,000 plus.
