I'm doing to my paperwork to get a conditional green card after marrying my husband (a US citizen). I'm currently on a F-1 visa (that has expired, but my I-20 is still valid for 2 more years). I work on campus and plan to do so for the next two years at least. Do I need to file I-765 along with I-130, I-485, I-131, I-864? Also, my husband didn't file his taxes three years ago (he was a student, he didn't know any better), so he can only provide tax documents only for the last two years. Will that be a problem in our application?

Do I need to file I-765 along with I-130, I-485, I-131, I-864? - You don't need to if you are intending on continuing your I-120 campus-based work authorization of no more than 20hrs/week until you graduate. Basically, as long as you choose to obey your status as a non-immigrant F1 student, you'll have to obey rules associated with it, even though filing AOS gives you an authorized stay as intending immigrate.

 

Also, my husband didn't file his taxes three years ago (he was a student, he didn't know any better), so he can only provide tax documents only for the last two years. Will that be a problem in our application? - If he didn't make any income or made less than $12,000 (in 2018), then he's wasn't required to file. For the application, they'll be interested in most recent income.
