I'm so sorry about what happened. And I really feel bad for the young child who is getting dragged along in this.

 

We as adults can process things and eventually move on, but young kids are a different story.

 

At this point the best thing for you would be to end this ASAP and break all ties. Your marriage most likely isn't valid, but I'd consult an attorney immediately on how to proceed since the mechanics/formalities may differ slightly between states/counties.

 

Obviously don't show up to the AOS interview.

From my understanding the beneficiary has returned to their home country already. I am sorry for your pain. It is good sometimes to vent and share your frustrations with others. I don't think there is any immigration advice to give. Sometimes things just go wrong between people. We aren't machines. Good luck in the future🙂

Write to the consulate (with her A-number in the subject line), efficiently explain the situation, suggest that the IV Fraud unit take note, and ask for acknowledgment that your message was received.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

both links let you make online reports.  The sooner this information is online the sooner and more likely USCIS and State will mark her as permanently inadmissible.

Nope. You can't force a person to leave. You can incentivize it and report it to USCIS but you can't make them actually leave?. I read that in this case the ex"wife" has already left, so the point is moot.

I agree that they didn't meet the requirments of the visa. However, a person can't be physically forced to leave the country except foe by the authorities. I read that the ex"wife" has already left the country now, but if she hadn't there is nothing outside of documentation to USCIS/ICE and incentivizing (buying her ticket etc) he could do. So frustrating for so many people who have been scammed. :(

You cannot physically force someone to leave the country, even when they've outrageously broken the law. You can withdraw support for them, send documentation of their actions, refuse to sign, kick them out of the house or incentivize a way back home, but you can't force them. If it were possible we'd have many fewer immigrants when awful scams like these happen.

 

I'm sorry for the OP and for that poor child going through all this. What an awful experience.

You keep using that word “can”. I do not believe you know what it means.

I never would force anything on someone. She was scared because she had been previously married and lied on the K1 app, so she didn't want to find out what would have happened. I am frustrated also, but I was blinded by loneliness and ignored the red flags. Now looking back there were plenty. So it is on me also, I just wish the child didn't have to suffer, that is my main concern.

I'm sorry for the OP and for that poor child going through all this. What an awful experience.

We all learn from are mistakes, like you expressed, I just wish that the child didn't have to go through all of this. Also, I never forced her anywhere, she was scared because she was previously married and wasn't sure what would happen if we adjusted status. I actually send in the forms for AOS and then I found out she was married to someone else. My lawyer said to cancel payment because there are no refunds and there is a good chance that they would have found out and maybe deported or worse.
