This is pretty harsh. Military personnel do get to expedite if they are under deployment orders.

As far as the orders go... I didn't have any, because you know how that is, sometimes I get my orders after I go. If you are stuck in that situation, have someone of importance in your chain write it out with the service letterhead, and that should be good until your orders are cut.

Also, from experience... I wouldn't rely on any JAG office for advice past a basic level on this stuff if they even give you any at all. There is a lot of misinformation out there and you really have to dig around yourself to get the best result. I've been told numerous things that just weren't right, like that I was required to get approval from the Commander, that I would lose my clearance and would never get promoted, etc.

To that other guy. They just are thankful for our service, and simply just help without expectation of return or a policy guidance staff meeting. I know that for some people that concept is difficult to understand, and especially foreign if you spend your life in certain career fields (law).

Those in our military on active duty and assigned to a war/conflict zone can have their cases expedited. I would include your military ID and information about your deployment in your I 129f package (can't hurt, right?). Once it is recieved by the service center & you have a case number, I would also call your elected representative for their assistance with the expedite. The previous poster had a good idea, too, about JAG. They may also be able to help.

Whether or not anyone here 'likes' this idea (or has some kind of grudge with the military) is patently irrelevant.

To that other guy, buddy, the people who help us out don't formulate a standard of need or think about things like that. They just are thankful for our service, and simply just help without expectation of return or a policy guidance staff meeting. I know that for some people that concept is difficult to understand, and especially foreign if you spend your life in certain career fields (law).

I mentioned "standard of need". I was talking about USCIS policies, not individual's who help. USCIS has determined that expedited service is available for those with pending deployments that could interfere with immigration issues. Your own case is a prime example. Other than pending deployment, I personally think veterans, deserve the same considerations active duty military would get for immigration issues. (The issue we're discussing.) I agree with USCIS that expedited immigration related service for veterans and active duty personell with no pending International deployment fails to meet any standard of need that could justify such action. I hope that makes my personal opinion clear as to both detail and context.

I know, sorry I got riled up and mixed up the posts! :)

I wish they had a military/State dept discussion forum here because I'd wager that a lot of people on this site are from this demographic.

Favoritism is shown to the military a lot by the government. I don't know why...it could perhaps be that we voluntarily offer our lives to protect the United States. It could be that 1000's upon 1000's of us have died defending the democracy and freedom that most take for granted. I guess that could be why.

There are other gov't workers, like firemen & policemen that risk their lives to protect ours too, do their visa's get processed faster?

As for the gov't showing favoritism to military... i heard that they took away that little benefit, like a free education when you return from service??

I've got the highest respect for police officers and firemen. MUCH respect to all them (respect is due). However, I don't recall them being dropped off in the middle of the desert with a round of ammunition and being told "good luck". I don't think they are surrounded by militants that have thirst for American blood and who will kill themselves just to kill you. Policemen and firemen can quit whenever they want. They are citizens of a local government, we serve the federal government under contract. We can't just simply quit when they decide they want to send us somewhere we have to go. Anyway, I shouldn't argue with fools...I'm done with this one.

Hmm, you didn't voluntarily sign up for the military? You signed up knowing what situation you will be put in, then why whine? Fools put themselves in danger.

JCochranUSN, do you have impending deployment orders? In that I mean, are you about to be deployed very soon? If so, that could be a reason for expediting. Just being military isn't necessarily a reason for expediting. There are a few couples who've had their cases expedited for impending deployment orders to Iraq. Other than that, like I said, just being in the military isn't a reason for expediting anyone's petition. IMHO of course.

Wow. Just. Wow.

Anyway - JAG might not be the most help because, from what I understand, they stick to military code stuff and don't venture too much into other practice areas unless necessary.

I think all military cases should be expedited. It is true that military service is voluntary, but frankly, then all the more reason to have incentives. Do the naysayers have any idea how much stress is on today's service men and women? How understaffed all branches of the military are? How difficult it is to get people to serve?

Don't worry yourself too much N&L - military wait in the same long line and frequently even deployment orders don't speed things up for them.

I don't have it in me to volunteer for the armed forces right now, but I wouldn't mind a bit seeing this be an added benefit of service.

(P.S. it's not a wholly free education they get when they get home or they retire, etc. Anyone who pretends that today's military is all glitz is seriously deluding themselves. The scars of war exist, no matter how much the current administration and a lot of pop culture denies that. Even if every soldier, airman, and sailor comes home with nary a physical scratch from now on, the scars will still be there in other forms.)

My husband was due to deploy in November last year, so his commander wrote a letter explaining the situation to USCIS, as he didnt have any orders. It did seem to speed things up as I got my interview for November 06, and my friend in the same situation has still not received hers. Nanusia & Lukaszek you may not think it is fair that some military get their case expedited, but I merely wanted to spend time with my husband before he deployed ,as there is always a chance that he may not come back. I think that military should have their case expedited as the possibility of deployment is always there.
