Has anyone seen any favoritism shown to active duty military who apply to get a K1 Visa? I'm not sure if they will help the process go faster for military or not.

Would it be inappropriate to include photocopies of my military ID with my I129 package??

21 JUL 07 : K1 package mailed to Nebraska Service Center

24 JUL 07 : K1 arrived in Lincoln, NE

24 JUL 07 : USPS status of package: DELIVERED:)

02 AUG 07 : NOA1 from CSC

If you can show pending deployment orders, expedited processing is available. If not, no. No harm in including copies of your ID.

As stated above - to be considered for expedition, a petitioner must be not only active duty, but have deployment orders (for those who don't know, deployment as in war/conflict zone). Active duty alone does not qualify.

Well you asked if people saw favoritism... Why would you even think that?

Favoritism is shown to the military a lot by the government. I don't know why...it could perhaps be that we voluntarily offer our lives to protect the United States. It could be that 1000's upon 1000's of us have died defending the democracy and freedom that most take for granted. I guess that could be why.

Hey Squid!!

There is an Army Lt on here who was able to expedite his paperwork for his Ozzie wife, he is about to deploy to Iraq. If you about to deploy, I would get with the legal officer onboard your ship or shore installation for assistance.

BTW, don't mind the one with the attitude, any and all military (Active, Reserve, National Guard, Retired) DESERVE any little break that they can catch for their service to their country, even if it is for someone one unappreciative of services. Sometimes you just want to reach through your monitor and ..........well, you get the picture.

This is pretty harsh. Military personnel do get to expedite if they are under deployment orders.

Favoritism is shown to the military a lot by the government. I don't know why...it could perhaps be that we voluntarily offer our lives to protect the United States. It could be that 1000's upon 1000's of us have died defending the democracy and freedom that most take for granted. I guess that could be why.

I appreciate your service but by that logic, all veterans should receive the same favoritism. In this instance, it appears not to have met the standard of need.

The direct concession is only that you'll need to meet 100% of poverty level instead of 125%.

You won't get favoritism necessarily, but there are codified sections of the INA and CFR's that allow military spouses expedited citizenship (not K1), specifically INA 319b. As far as K1's go the only thing I can think of is that some embassies might allow you to use the direct file option if you are military. Also, I think the fact that you are serving your country still holds weight at the interview table, and your motives may not be questioned as much. Other than that, you can send in an expedite request for an unusual sitution that may or may not be considered.

Myself, I filed for a fiancee visa in the states and got orders to Korea about 6 months into the process, so you might be able to see the complexities involved, namely that just as I was leaving for Korea, she would be arriving in the U.S. If she didn't arrive before I shipped out, we couldn't be married in the required 90 days, she would have to return home, and the whole process starts over - months of waiting just vanish. She did end up arriving just before I left, but she lived in the States for months alone until she got her green card.

I explained this in a letter and it seemed to help, but the process still took 6 months.

To the other person, servicemembers may not deserve anything extra for *just* being in the military, it's just that constant deployments to foreign countries tend to create difficult or impossible immigration situations. If the above situation was Iraq or even Japan (places my would-be fiancee couldn't get a visa to join me) and not Korea, I would have had a fiancee arriving in the U.S. for the first time trying to figure out how to live, having no friends, no way to get around or even know the most essential things about surviving in the States, and on top of that, I would be in a combat zone for the first 12-18 months of my marriage after waiting 6-9 months while the paperwork crawled its way through the process.

Even if all of that weren't true, there are still a lot of people who think that those who volunteer for military service do deserve a helping hand every now and then in whatever way they can give one, and we appreciate it more than they'llever know!

As far as the orders go... I didn't have any, because you know how that is, sometimes I get my orders after I go. If you are stuck in that situation, have someone of importance in your chain write it out with the service letterhead, and that should be good until your orders are cut.

Also, from experience... I wouldn't rely on any JAG office for advice past a basic level on this stuff if they even give you any at all. There is a lot of misinformation out there and you really have to dig around yourself to get the best result. I've been told numerous things that just weren't right, like that I was required to get approval from the Commander, that I would lose my clearance and would never get promoted, etc.

To that other guy, buddy, the people who help us out don't formulate a standard of need or think about things like that. They just are thankful for our service, and simply just help without expectation of return or a policy guidance staff meeting. I know that for some people that concept is difficult to understand, and especially foreign if you spend your life in certain career fields (law).

There are other gov't workers, like firemen & policemen that risk their lives to protect ours too, do their visa's get processed faster?

As for the gov't showing favoritism to military... i heard that they took away that little benefit, like a free education when you return from service??
