RFE - Birth Certificate

Hi guys. I applied for my wife’s adjustment of status application back in July 23 and I just heard back from them.

Unfortunately, they are asking to resubmit the birth certificate. My wife is from Rajasthan, India and her birth certificate was issued on February, 2020.

 

I am not sure why are they asking for it again since one of the officers already uploaded it under the USCIS account. The only problem is that I can find is that when I reviewed the birth.certificate online, it is hard to read it. 

 

Have anyone received similar request regarding the birth certificate? If so, what should I do? Should I request for the same birth certificate expect that it should have a new issues date?

Late issued birth certificates usually require more evidence........good luck.

Also, my wife did not do her medical test in the USA. She came on the K1 visa and she did her medical test in India. She did it on April 2021.

Even if you sent her BC before , you need to send it along with AOS..i

Her medical is fine as long as you apply for AOS within a year.  .

Same thing happened to me  for  my birth certificate also instead of upload  three times in one of  my documents by them ,my bc was issued on 2019 ,I did upload the same again as RFE after scanned it

Thanks for getting back to me. I will probably use the the same birth certificate that I originally sent them. I have a question for you. Since I will be using the same birth certificate, any idea how long will it take for them to approve it?

Yes..it can vary from weeks to months.  What's your field and processing center?

Just got RFE on 22nd September, replied same day, honestly speaking don't know how long I have to wait, but I don't have other options for my bc .it's all waiting game for me.....

Are you saying that you did not include her birth certificate at all in the AOS packet? It is clearly listed in the I-485 instructions as required evidence. You are lucky they sent an RFE instead of a denial for an incomplete packet.

 

Just send exactly what the RFE asks for.

I already included it in the AOS packet so I wasn’t sure why are they asking for it again. Anyway, I’m going to submit the same birth certificate that I submitted before.

If you did already include it, there could be an issue with it. What exactly did the RFE say?

 

There can be several reasons for the RFE:

- The certificate is not legible. Send a better copy.

- You did not send the correct version. Many countries have several versions of birth certificates; make sure you send the correct one. 

- The certificate is not in English. I got an RFE when I sent my international birth certificate (with 12 languages, so apparently it was too hard to find the English part). I ended up creating a separate document with just the English, and included a translator statement.

- If there is a translation, the statement from the translator is missing. 

- They simply lost the one you sent and need a new one...

What does the RFE exactly say? Exact words? Resubmitting the same that they already have doesn't solve the problem and in fact may result in denying your i485 for not providing what is requested.

In July 2021 filers group we have several people who already submitted BCs and they can see them scanned in their account, yet they still got RFEs. So it could be a similar situation.
 

However, your BC was issued very late. It could be a problem. I suggest, to be safe, to send any supporting documents, along with the copy of BC. It could be hospital records, earliest school records, affidavits from parents, etc.

If you submit the exact same BC that they already have, you're risking a denial. They already have it, so uploading the same thing is not going to bring any different outcome. As others have said, it could be a myriad of issues. 

- Not the right BC (many countries have different types of BC.

- BC not in English. If it is translated, there needs to be a statement from the translator.

- Copy is not good.

 

Either way, there is a document reciprocity webpage from the US Department of State that I used very frequently during my AOS to make sure that USCIS would accept my documents. You tap on "India" and it tells you what their BC looks like. This is what the US government wants to use. Also, if you don't have any other copy of the BC, I would look on that webpage and find alternate documents for a BC. These documents should also be listed on the RFE letter. Please don't submit the same, you risk a denial and having to start all over.
