Importing Firearms with K1 Visa

Hello everyone,

 

My fiancé and I do shooting competitions and when she moves here she is intends to bring her handguns with her.  Is this feasible with a K1 visa?   It appears we would have to fill out a ATF Form 6 Part 1 but it is not clear on the process after getting the authorization/what to do in the USA with them.  

Has anyone done this or do you have to wait until you have a green card to actually bring them here for permanent import?  Any advice would be greatly appreciated.

What do you mean by do? Be aware there is an ammo shortage so I would bring supplies

Make sure she can meet all state/local requirements for ownership of these particular guns upon arrival? (i.e. will she need a pistol permit/background check, are any guns subject to assault weapons laws/registrations) 

 

If there are requirements she can't meet right away, I would hold off importing until after everything is taken care of.

We both compete in USPSA/IPSC... I load my own so I have no shortage here.

That is the part I'm trying to determine.  What is being imported is legal to own where I live, I am just trying to understand the actual process of filling out the Form 6 Part 1 and then what happens after you cross the border with them.

You will also need to check the laws of every state you travel through.  For instance, in NY you are allowed to transport handguns as long as you are allowed to have them at your origin and destination, they remain locked in a box with your belongings, and you do not stop to stay somewhere overnight like a hotel. Otherwise its a felony if you get caught.

 

Definitely call where you plan to cross and ask for advice.   K-1 is a nonimmigrant visa and it clearly states nonimmigrants are not allowed to permanently import weapons, you can temporarily import them with ATF Form 6NIA for non immigrant purposes (hunting, work, sports, etc). But since the intent of the K-1 is to immigrate, they may allow the ATF Form 6 Part 1.

Hey,

Just saw your post (I'm not on here often anymore).

I brought my handgun over when I moved here & we just filled out paperwork it was easy.  No waiting until green card.
Where are you located?  We/I competed in USPSA/IPSC as well!

8/2/2021:  Mailed N-400

8/4/2021: N-400 received

8/6/2021:  Biometrics to be reused
3/15/2022:  Interview (successful)
