Timeline

Been having thoughts about my options and have read some mixed responses. My wife has her 2 year greencard, and we have filed for the I-751 back in Nov of 2019, and she did her biometrics a few weeks ago. She has changed her priorities a lot since coming back from China back in June of this year because her father is in legal trouble. There is a lot of other stuff going on that has made me rethink what this marriage was intended for, which was to start a family since I had waited til my mid 40s to finally get married. And there are other issues going on that lead me to believe that she is changing her mind on a lot of things in our marriage.

  I can still remove an I-864 as long as there has not been an interview or 10 year green card issued? I'm just weighing my options and thoughts before I act as this is a huge decision.

No.  You are obligated by the I-864 you submitted until one of the following:

1.  Immigrant becomes a citizen

2.  Immigrant has gained 40 quarters of SS work credit

3.  Immigrant has lost status a a legal resident and departed the US

4.  Immigrant dies

 

It might in your best interest for her to become a citizen as soon as possible.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Guess I thought that the reason a 2nd one was done (1st for aos and 2nd for roc) was because ROC had was still needing to be approved.

There is no I-864 for Removal of conditions. The one you’ve done for AOS - green card issuance is still in effect.

That would be a better deal if that happened like that.
