The petition has been approved.  You now need to file the I-824 to get it into consular processing.

Well I guess if you can't follow the literal questions on the I-130, don't understand the I-824, or read what you have been told here, then maybe a lawyer isn't a bad idea.

Here are the steps if you want to do it yourself:

1) fill out the I-824.  If you don't understand any part of it re-read it and then ask here if you still don't understand.

2) fill the I-824, pay the fee and wait.

 

Current processing time is 3 to 13 months for the Texas Service Center.   That window will be different if it is assigned to a different service center.

You are applying for your approved petition to be forwarded to NVC. You are the applicant for i824. You'll fill out the applicant's portion not the preparer's portion. 
 

You already wasted $465 with up to a year of delays by putting wrong info on i130. Don't make that same mistake. Read the form and instructions very carefully.

Where does it ask for her signature? Your mother has no role in filling i824.

What you are trying to fix is to get the petition forwarded to the US embassy so your mom can be interviewed there. NVC is the agency that processes the documents and forwards them to the USEM.

So you'll need to file the I-824 so USCIS can send the approved petition to NVC who will eventually collect documents and forward the petition to the USEM. 

Since you made a mistake on your I-130, read the instructions carefully when filling the I-824 and ask questions here if you need help. 

I-824 is not a complex form to fill so I don't think you need a lawyer but if you are scared you'll make another mistake then sure you can pay a lawyer to do it for you.

But again, I'll advice you to fill it yourself but carefully read the instructions and the form itself when filling it. Unfortunately, you'll have to pay another fee for I-824.

So you’re saying to check the box that States im the applicant and not petitioner?

I am not saying that. That section is asking if you are the "applicant" or the "petitioner" for the approved i130 (not for form i824) so you'd select petitioner.

 

Saying it again, you are the applicant for i824, not your mother so you will sign the applicant's section.

 

Usually we'd say you can DIY any uscis petitions/applications while asking for some clarifications over here but this is where i say you are probably better off getting a lawyer so you don't mess this again like i130.

So far i have selected that i am the petitioner prior to coming into this page to ask questions.. I just haven’t filled out the applicant or preparer’s section yet because I was unsure.

Also, Part 4 6a of the I-824.. Applicant’s statement, contact information, declaration, certification, and signature. - For form I-824, you are the applicant so you'll only complete the applicant section. Not the preparator section; you'll only complete the preparator section if somebody else prepared the form for you (example, a lawyer, a friend, etc)

 

 

-for form I-130, you are the petitioner and your mon is the beneficiary 

-for form I-824, you are the applicant.
