I-824

Hello, I am a US Citizen and I am trying to bring my mother here. The I-130 got approved and I am filling out the I-824 while my mother is in a different country. But I am confused because I am not sure if I am filling out the application myself or is my mother supposed to fill it out because it requires her signature.

When did it get approved?  Normally it is sent to the NVC and you get a welcome letter ( after some time), An I-824 is for a petition that was approved but never was interviewed and gets the petition out of storage and moving on tis way.

The I-130 got approved in august and i am currently working on the 824

Were you instructed to file an I-824?   If anything you should be looking at an I-864 for the NVC process.

From what i could read, it stated the I-824 on the approved letter.

Did you happen to check "adjustment of status" option on i130?

Reread it -  that isn't a common item for an I-130 for a family member overseas.   But the answer your original question, since you filed for you mother you are the petitioner.

I will re read it. But also do i fill out the preparer’s portion? Since I am the one getting the application ready?

The above petition has been approved. The petition indicates that the beneficiary is in the United States and wishes to apply for adjustment of status to that of a lawful permanent resident. He or she should submit a copy of this notice, along with a Form I-485, Application to Register Permanent Residence or Adjust Status. That was a $495 mistake. Since she is not in the US (you checked Adjustment of Status), file the I-824 and pay the fee.  If you didn't check the adjustment of status box you need to contact them to send it on the the NVC.

As you can see in the picture i didn’t fill out the part where it asks if she was in the US nor did i check any box for adjustment of status.

Note the correct section. Look on the next page . . .  Items 61 & 62

Wow i think you may be right. I thought it was asking where in the U.S she will apply.

Sorry - it was processed as if she was in the US.
